  • All repit may be worthwhile lies are relevant, however be careful as your friend could still be on her probationary period, if she does not want to rock the boat it may be worthwhile to wait until they have been there a year when they will have full emplyment rights.

    Good luck

I dont see the problem, I used to work in a shop and always turn up a good 15 minutes early to ensure I was dressed and ready to go and also stayed a little late every day to make sure the shop was clean.

In my current job I regularly arrive up to 30 minutes early most mornings so I can have a cuppa and read my emails before settling down to my work for the day.

I dont have to do this but I like to as it means I dont have to rush around the second I get to the office

It's always better to be late in this life, than early in the next

There's a difference between that and being expected to hang around and work up to an hour after it is supposed to finish, on numerous occasions.

:rotfl: You may be sure, but you are wrong.

There was a guy who had his foot amputated after a forklift hit him and the employer said the guy should not have been on the workfloor as his shift finished 30 minutes earlier. The employer is a major supermarket chain and is fighting the case.

Savvy sue i need send him your details as obviously you know more than the health and safety executive who told him it was illegal for him to be at work at the time :)

If the H&S executive is a person rather than The H&S Executive, then I guess he is paid by the employer.

If it were illegal for an employee to be on works premises other than during the exact period of shifts, then a lot of workers are behaving illegally rather often.

One also presumes the company has public liability insurance which would cover visitors to the site. Perhaps the employee would be covered by that out of contracted shift time.

I remain sure it is not 'illegal', but as I said, it may be outside the employer's H&S policy and practices, sounds rather as if it was.

He should ask the employer to show him which law, as passed by parliament, he was breaking. And also ask how he was ever supposed to work his contracted hours if he couldn't be there either early or late.

A relevant question would be, what WAS he doing there 30 minutes after his shift ended? The employer might well have a case if he really should not have been there ...

I think I must work illegally everytime I go to work in the NHS then - not just me but almost everyone.

"Sorry Mr Jones - we can't finish your operation as we would be working illegally. Can you hop off the table and back up to ward asap? We'll be back at 8.30 on monday morning. "

I suspect DH works more hours illegally than he does legally! I spotted a folding bed at his work the other day, he said it wasn't for him but sometimes I wonder! :rotfl:
