how long to sort out claim ?

Hubby had acccident in may 2007............statis now after taking a civil case against other driver it was decided in court other driver was laible and I recieved my acess back and also the costs involved in car hire while my car was written off and new car found. I had fully comp insurance so they paid for my car loss and I got another car within a few weeks.

Hubby has also had offers in relation to his person injurie claim so no issue with other drivers insurance paying out now liability has been sorted but............

they have not paid my insurance company yet for the claim I made for the loss of my car, so technically I still have unsettled claim on my car insurance. I have protected NCB so that is not an issue but the problems I am having are......

1. My insurance has just been renewed and for second time I had to stay with same company as to change companies with a " unsettled claim" was a nighmare even though my NCB was protected as soon as I mentioned the claim bacically the premium went way up and the other companies told me to stay where I was.

2. My husband and myself want to get added to our DD insurance but can't again because of the cost as this " unsettled claim" is showing. he insurance company can add us free to her fully comp insurance if we have no claims but are looking about £600 to add us with this claim. As we only need to be able to drive her car occassionally not worth paying that. Again advised by them to wait until the claim is shoing as settled on our insurance.

Now I am getting totally fed up with this...........I have just rang my insurance company AGAIN and they have send a number of letters to the other drivers insurance and they have not even replied. My insurance company keep saying " don't worry sure your NCB is protected" but that is not the issue here.

How long do I give my insurance company to get this sorted ? The court case was in January. The last time they wrote to the other company was 27th March. As technically this money is owed to them and not me can I do anything ?

I am just fed upw ith another car sitting here I cannot drive if needed to as I am only covered third party to drive it and as it is a 4 month old car I am not prepared to do that.
TOTAL 44 weeks lose. 6st 9.5lb :T

    Are your Insurers aware that you have recovered your excess from the other Insurer? This is normally proof that the accident is not your fault.

    Ring the underwriting / customer services department of your Insurer and explain you have recovered your excess. They will normally then mark the claim as being non fault (They will normally want you to send a copy of the letter that accompanied the cheque for your excess into them as proof)

    yes they knew I have recieved access etc, I have forwarded the letters from solicitor. the insurers are trying to get the money form other drivers insurers but have not said if claim is marked as non fault or not,will check that out thanks.

    Like I said speak to customer services / underwriting as they are a completely different department to claims and should be able to advise you whether they have updated their files to show the claim as non fault if not what needs to happen for this to happen.

    got it sorted, the other insurance company had apparently " misplaced" the file but after a phone call from my insurers are sending the cheque today and my company has marked the claim as closed

    Well done, that must be a weight off your mind, sometimes insurers need a gentle prod with a phone call to tidy things up
