PS3 Game Help !!

Hi this is my first post and altho i have not posted i have been reading these fourms ever since was made aware of them in 2005 and have helped me to no end. i always refer people here when they get a problem as a solution can always be found.
Now i have a dilema to which i have not seen a solution for or made.
it goes like this, I purchased a ps3 game from their preowned section back in late September or probably earlier. This was GTA 4 for the ps3 the game worked really well up untill a few days ago. i pop in the game and it refuses to load, i don't understand it. i eject the disc and take a look at it, there is a small crack on the underside of the disc leading to a hairline crack (very faint) on the disc itself from the intial crack.
i don't understand how the game could get like this and i really look after all my games and discs so you won't find anyone better at treating thier games especially with hard earned money spent on them.
my problem is that i do not have a reciept to this game as i purchased it a long while ago not expecting for this to happen, and practically i have a coaster.
One thing i must say is after calming down and ranting about on a lost game is that i noticed the game case after putting GTA4 away. When you place any DVD or game in the case you have to lock the game down by applying pressure on the center of the disc to lock the disc to the case so that the games or DVD do not knock about in the case and get scratched. And to release a game you have to push down on the center to release the game. so am i right saying that the crack was caused by this locking/unlocking mechanism ? and it was totally out of my control. i have never had this problem before with my other ps3 games nor DVD's and some of them i have had for alot longer then gta4.
now is there anything i can do about it because i do not have a reciept no more for the game and i know i paid cash for it and all i want is a replacement disc and i don't want to folk out £19.99 for another pre-owned version of the same game. any advice on who do i speak to and what shall i do

Of course there is nothing you can do - you have had the game for months and it was second hand to start with! These things happen sometimes, you won't be able to prove that it wasn't just wear and tear / repeated removal of the disc from the case that eventually cracked the disc.
You don't even say who you bought the game from but I doubt any retailer will give you a replacement.

As Beanie says there is probably not much you can do. The Sale of Goods Act applies to second hand goods so they still have to be fit for purpose etc but the price can be taken into account when establishing quality.
If the disc developed the fault within the first 6 months of purchase, the retailer has to prove that it wasn't faulty at the time of purchase. After 6 months the consumer has to prove it was faulty. As you bought the game more than 6 months ago, you would have to prove it was faulty and the cost of doing so would exceed the value of the game.
It may be worth going to the shop and explaining the problem; you may convince them to replace or give you vouchers.0 -
i got the game from the GAME shop (used to be called EB till they changed the name to GAME)
i will go to game and ask them what can be done and see if i can get a replacement or get it repaired or something.

You cant do anything, theirs not really a fault with he game, just excessive wear and tear, maybe not your fault but wear and tear none the less.
Ask game but they have no obligation to do anything, and from my experiences they wont, would go around trying to sell it and hope they dont notice, very dishonest i must say but the next buyer would notice its faulty and the shop would be out of pocket not the customer so thats not as bad.Back by no demand whatsoever.0 -
Blockbuster had GTA4 pre owned for £7.99 last time I looked, it was a sale but might be the same price.0

last time i went to blockbuster 2 weeks ago looking for some random game to play it was around 20 quid then. so i will pop in tomoroz and check it out and hope im lucky enough to find it at £8 .
