Service Charge Arrears issue

Apologies if this is not posted in the correct place but I was after some advise regarding a Service Charge issue.

In January we received a Service Charge Invoice from CPM on behalf of our management company for £85.19. I sent the remittance slip back with a cheque for the full amount and thought no more of it. Until this morning...when we received a letter from Property Debt Collection ltd acting on behalf of CPM for an unpaid service charge arrears of £169.14. This letter also states that an application to the court will be made in 14 days for a CCJ and costs.

I phoned CPM and explained that I sent the cheque in January with the remittance but it seems they have no record of this. Having checked my accounts it seems that the cheque was never debited from my account. I guess I should have made sure that the charge was paid.

However, CPM also claim that they sent a Final Demand for payment in February which I explained we had not received. The representative then advised that I should contact Property Debt Collection Ltd and request a dispute form from them.

However, I cannot dispute that the original £85.19 was paid as it hasn't actually come out of my account. I am happy to pay this but feel a bit aggrieved that I should have to pay double the original amount as a consequence of the arrears.

I have also just found out that many of my neighbours also received the same letter (although I cannot confirm if they sent payment or not) for the same amount.

If anyone has any advise on how I should proceed it would be very much appreciated.

    only a court can make you pay any additional amount over and above the original debt.

    send the original amount by recorded delivery, with a stamped addressed envelope for a receipt and with a covering letter saying that you present this cheque in "full and final settlement of this debt"

    if they cash it without writing you a letter to dispute that they are not cashing it in full and final settlement, then you are in the clear.

    debt collectors simply try to bully people - they have no legal authority to increase the debts they are trying to collect

    threatening to apply to the court is just bullyboy tactics
