Can anyone give us some advice?
My husband has a credit card with MBNA. It is currently over its limit by a couple of hundred pounds. For the last 2 months he has nothing but harrassement from MBNA about it. Back in February he made a payment agreement with them & was told that because he had set up that agreement that no details would be registered with credit reference agencies. We then started getting phone calls, letters & texts from a collection agency called AGIS. These were coming in daily, despite my husband repeatedly telling them that he had an arrangement with MBNA. He contacted MBNA again who said there was no agreement showing on their computer so he had to set it up again. THe person at MBNA assured him that it would go on the computer & that he would receive no more communications from AGIS. But AGIS kept ringing!! For a third time he called MBNA, again there was no agreement on the computer, again he set it up. Whilst all this is going on I should add, he is making the agreed payments to his account. We then start getting letters from another collection agency RMA. He calls them, tells them he has an agreement & he wants to complain, they say they cannot accept or set up agreements & he should call MBNA to complain. So he calls MBNA & guess what? No agreement on their computer! Once again my husband arranges a payment agreement, is told that all charges & interest have been frozen & that RMA will be told to stop ringing.
Today we receive a card in the post from RMA saying they will be calling tomorrow. They rang this afternoon. We also get a letter from MBNA saying he is persisting in non-payment & details have been registered with credit reference agencies. My husband rang MBNA, who told him that they cannot stop RMA calling & that they will not stop calling until the arrears have been cleared. They also told him that the interest has not been frozen, only the charges. MY husbands stress levels are reaching breaking point because of this.
So who do we complain to for the best result? MBNA said today that he should compain to the Office of Advocates? Feel we should take this higher as MBNA seem totally useless.:mad::mad:

I think you need to stop calling and start sending letters by recorded delivery. The issue here has arisen from you not having any record of agreements made between you and MBNA; a verbal agreement for something like repayment terms on a default just isn't sufficient. Write a letter of complaint immediately, explain the whole situation from start to finish; names, dates, times and what was agreed. MBNA then have to respond, or you can later proceed to the Ombudsman.0
