Can you help me my sisters dog bit her neighbour

    Hi

    I have been away for a couple of days to escape and recharge batteries after a difficult few months with one thing and another.

    Must say all the support is very welcome and my sister is also grateful to know there are people out there that are not like her neighbours, so once again thank you.. She will be trying to sell the house for almost anything.

    I had also not realised about the DDA. I wanted a dog and ended up with a house rabbit. I am beginning to see the benefits. Must say that the fact that it is up to you to prove your dog did not do it, is very tricky, she has put the dog out in the same garden, for years and nothing like this happened, and given the dog is not a nasty dog she can just be a bit nervous. I will be phoning later to see how she is, but with my mum dying this is probably the last straw and I do not think she is coping well.
    Will post any further news.

    I was always under the impression that if your dog bit someone on your land then it was tough luck else whats the point in having a guard dog? I can't find a link to the story but there was a guy last year who had a Jap Atika in his back garden with a high fence and warned his neighbours the dog would bite if then went into his back garden. Anyway neighbours 11 year old son climbed on a shed and climbed over the fence and the dog attacked him and bit him very badly. The police refused to get involved as the boy shouldn't been in the back yard in the first place.

    I guess the dog biting someone through a fence is a grey area. I would never ever trust my dog to be out in the garden on its own because all dogs are animals and even the nicest dog can attack. Just look at the kids attacked by their family pet who have never hurt a fly before. Also despite their being 100s of dogs looking for homes people steal dogs from gardens. You wouldn't leave a baby in the garden alone so why a dog?

    I have an update as police went to see my sister today.

    They had confirmed with other neighbours the dog has been wearing the muzzle when it is out in the garden, they measured the wall and noted it was very loose at the site of the alleged incident. Also yesterday my sister asked the postman if he was afraid of her dog, he replied he did not even know she had a dog, that was reported to the police, they had also confirmed she only had her mail delivered when she was away visiting my mother and for no other reason. It looks like, they are beginning to see there is another side to this story.

    Surely enough if the dog was on your sisters property how did the person get bit? If they put their hand over they are tresspassing? The dog would attack in protecting their home.

    I've had my lab x for 9 years now she has never bit anyone or even showed teeth but if people ask me does she bite I say she hasn't yet but I can't promise she wont. Because you don't know what sort of mood the dog is in sometimes.

    I hope your sister is let off and her dog gets to live.
