Spend on Credit Card - AMEX

Long long time browser ----> first post!

I recently went to a restaurant and when receiving the bill the writing was handwritten and hard to read. - The waitress read the amount wrong and I paid the amount on my credit card (AMEX).

Yesterday I noticed that they had taken a further amount from my card (I did not chip & pin this) and when calling them they said the waitress charged me the wrong amount - so they added a further charge.

What are my rights here?
I think I should have originally paid the higher amount but I think it is unlawful for them to take money without my consent.

I am disappointed with the way they have done this :mad:

    Probably not legal to take more out of your account that you authorised, but deep down if you owe it is there a prob paying it?

    No there isn't a problem paying it as I was expecting to pay it anyway...

    but can companies really do this? If so what is the point of chip/pin/signature!!!!

    The best thing to do is call the AMEX people and ask them to sort it out for you.

    Thats correct. You need to call AMEX

    Ok, Just got off the phone to them (I'm impressed - very quick to answer the phone and no 0870/0845 number to call!)

    The lady I spoke to said that they cant take the money if it wasn't chip & pinned - I confirmed I didnt chip and pin the second amount (the restaurant took two transactions). She seemed to think I must have...

    Anyhow, it is now with the AMEX dispute team and should take about 45 days to follow up...

    If there is a dispute about whether you approved the second payment, shouldn't it be stored on your Chip? That is what it is there for.
    If it isn't stored, then it didn't happen.

    Thing is though mate you don't owe it after you've left the premises cos at the time of sale he was told the amount and paid it in good faith.

    I'd be disputing it with Amex and tell them that you believed the amount to be right, you had it read to you verbally and did not authorise the 2nd payment.

    Amex should refund you, no probs. Its the retailers loss for advising you the wrong amount.
