Will the insurers not let your brother add legal cover now? My husband's insurers let him pay for it when he had an accident.0

Sounds to me like they're insurance scamsters. Insurance claims always go against someone who goes into the back of someone (as it's your responsibility to keep your distance and brake etc). I would look into pointing this out to the insurance companies involved.
On another note if an insurer offers legal cover for an extra £20 or £30 it's worth it.
This could be the case. Your brother should at least write down exactly what happened now whilst it is still fresh in his memory.

I'm surprised with the story and back up of a witness that the police didn't start to think about pulling a driving without due care charge on the driver.0
