I'm not sure what Ebay's policy states about this but as long as the auction is withdrawn and not let run to the end there is not a lot they can do as you can always say that the item is lost or broken.0

You see this quite often especially on items which are difficult to ship. I don't do this on sale items and I will not bid on items marked in this way. You can easily withdraw an item as no longer available for sale and I have done this from time to time were I have discovered defects in the item and cannot modify the description to match the item.0
