Have i got the rights for to request for another new car ?

Hello,

My partner just purchased a new car less then 5 months ago, two days ago, the engine coolant and oil tanks just dropped from the bonnet. The car is now back at the car dealer. Can we request for a new car and not go for the repair.

    I would have thought you would have been outside the time to reject it under the sale of goods act,and the work being done will be covered by the warranty anyhow.

    When you say the oil tanks,would you care to elaborate on that,as the only cars I know to have oil tanks,are dry sump race cars that have the oil in a tank usually in the boot,and the oil is in there rather than in the sump.

    Check for any other damage when you collect it,and make sure that the dealer makes good any repairs.

  • Sorry, gave you wrong info, water is leaking from the coolant heavily and engine oil is leaking too. Under the sale of goods act, how long do I have to request for another vehicle ?

  • The SOGA isn't that specific. If the garage repair the car satisfactorily i would leave it at that.

    You have been unlucky but that is what the warranty is for (i'm assuming by new you mena brand new). If it happens another couple of times then yes i'd start worrying SOGA untill then my advise is grin and bear it.

    When you say new car, just how new? As you haven't given us any info...
    If it's new and under 5 months old as you say then it will be reapired free of charge under the warranty.
