decre nisi

Hi, just a quick couple of questions hoping someone can help

decre nisi due to be read tomorrow and a letter has been received from court to say that judge has looked at paperwork and will be granted on this day.

2 questions

1. what happens about arrangements for children, do these have to be set in stone or if parents are in agreement can they just have an informal arrangement outside of the court?

2. finances - how do you go about a clean break order - some debts in both names although one person only paying them at present - how can an agreement be met and does this affect the divorce?

    When my decree nisi was granted, I couldn't file for the absolut until agreements for both finances & children were in place. This took about 3 months (I think, but it was 8 years ago!)

    I can't recall doing an agreement for the children, just an informal one that we both agreed to......

    and as his ex is a pain in the rear I can imagine it might take us 8 years to sort out lol not 3 months :-)

  • When I got divorced the finances were all sorted well ahead of the decree nisi being issued but we did have to put together an arrangement for the children on a form which went to the court with the divorce petition (we have a shared care arrangement so not sure if this was why?)

    well god knows what will happen then, I know there were questions relating to the children on the divorce forms, ie where did they live access arrangements etc..... but nothing as far as I am aware re the finances. no property to be divided up etc so not sure what will happen....

    oh well guess will have to wait and see....

    Is it you that's getting divorced dipsy or your OH?
    If your OH can he not find out?

    its my OH and its a bit complicated lol

    he did half divorce through solicitor final bits doing himself no financial bits done so not sure what needs to happen with regard to that....

    Sounds like he may be better off going back to the solicitor if he's unclear about the important bits!

    well there are no assets to divide up, just debts which currently he has a majority of them although in both names....

    guess he will need to go back to the solicitors as you suggest.... thanks again for your help

    All the financial arrangments should be covered in a 'Consent Order' this costs approx £350 - £500 for a solicitor to do it is the lodged at court for a judge to approve or not approve...He really should seek legal advice about this.
