The person you were speaking to probably did not realise that your OH was due one week at the old rate and one week at the new rate.

This story has moved on as life has a habit of doing,OH could not get work sadly only 1 interview in 4 months so OH will be a student full time so is unavailable for work from Monday 7th Sept
1) First signed on 18th March 2009 (see original post)
2) Hes next due to sign on 14th Sept
3) He cant get into the DWP office to sign off until Thursday 10th (I believe it has to be in person ?)
Questions please
As it is back dated when should he receive his last payment & how much ?
Will we end up owing them ?
This weeks has gone in today but not sure what dates exactly it covers up to

Hi Missy,
Your OH is paid fortnightly in arrrears, so the payment you received on the 3rd would be what he signed for on (or didn't because of the bank holiday if you get my drift!) Monday 31st.
He needs to complete his signing on book (ES40) stating that the last date he wants to claim for is Sunday 6 September. He can post this book or get someone else to hand it in for him, but it's probably best he does it in person if he can as, in my jobcentre at least, internal post takes an age to get where it's supposed to be going!
Once that book is received and actioned, he will receive a final payment from Tuesday 1 to Sunday 6 September inclusive. Staff in both the jobcentre and the processing section need to do this, so it may be worth ringing the processing centre a couple of days after handing in the ES40, just to make sure the claim has been completely closed and monies released. As you can see, it will be for just short of a week's normal JSA - so about £55?

What is wrong with DWP nothing is ever simple
Got a letter today about OH signing off
He signed off on Monday 7th Sept 2009
They back dated that to Sunday 6th Sept as his course started on the 7th itself
Ok so letter arrives today confirming he was signed off on 7th August 2009 :eek: a month earlier than it should be,human error im guessing
Needless to say the £55 was not paid in either
Oh has rung them the woman said can you prove you signed off on 7th Sept ?
OH well no because I signed the form then handed it in

OH said to her think about what courses do you know that start in early August ? thats when they are all shut

I take it you OH didn't write 08 instead of 09 in his ES40? Just a thought.
There are a couple of possible things you could try. The DWP use 2 computer systems. One only jobcentre staff have access to, the other - the processing team (where the letter came from) also have access to. Your OH could ask the jobcentre what date is on their system ("LMS") - if that shows 09, they can contact the processing team and ask for it to be amended as it's an error as you say.
You OH's ES40 will be filed in his claim in his local jobcentre, so again he could ask them to locate it and confirm what date was on it and if necessary amend the computer records.
The last thing would be a letter, with confirmation of the start date of his course (from the college) and asking for it to be amended, but this could take a while - it would be up to the processing centre to deal with it. Unfortunately no matter how obvious it is that colleges are closed in August, it does need to be in writing and the processing centre don't have access to his ES40, only the information on the computer system which is telling them he signed off from 07/08. They can't just amend it - even the jobcentre staff will need to give them written consent to change it if it turns out to be an error at their end.
Tell him the first two tomorrow if he can. If it is a simple error of keying in 08 instead of 09, that can be corrected and they should be able to do an immediate payment.
