only claim 5 years worth of credit card charges in Scotland & not 6 like in England/Wales

If I go back 5 years I can claim £xxxx.xx (£xxx in charges + £xxx.xx in interest)

But if I go back 6 years I can claim £xxxx.xx (£xxxx.xx in charges + £xxx.xx in interest)

That extra year is potentially worth £659.14 !!!

Should I try for 6 years anyway?

Would that affect my claim for the 5 years in any way? i.e. could they say that because I claimed for 6 years instead of 5 my whole claim is null & void?

  • The Statute of Limitations in Scotland is 5 years which is the reason.

    Another question...

    Just going through my statements & 1 month as well as a late charge & an overlimit charge I got a "default fee" of £40.

    Can I try & claim back the "default fee" like I can late & overlimit charges?

    yes you can claim default fees

    New question about the above

    Although I'm in Scotland my credit card is based in England. I just checked the terms & conditions & they state:

    "This agreement is governed by English law & you agree to the exclusive jurisdiction of the courts of England & Wales"

    Does this mean I can can claim back 6 years of charges instead of 5 & take them to court in England if necessary?

    Yes :) i believe you need an address for docs within England/Wales Jurisdiction, not 100% on that though. have a wee google.

    Which card is it?

    Also I'd claim for all time and let them beat you down to six or five years :) if it comes to court decide then whether to go through English or Scottish courts.

    I've got family in England & my aunt has already said I can use her address so I'll probably go down that route if possible

    I've been using the search function to check loads of old threads & I've seen quite a few posts about using an English address to get the 6 years. Most of them are from a few years ago though so I started this thread to see if there was any recent info about it.

    Its a GM Card (HFC) by the way
