hip pack help

Hi we are in nearing the end of our house sale and its a bit of a rush as our mortgage offer for our new house expires in 3 weeks. we have been waiting on the buyer of our house to pay for his searches and have found out today that he is adamantly refusing to pay for his local searches and mining searches saying that we have to pay them as part of our hip pack. i have looked at our hip pack today and it just says that the local searches have to be less than 3 months old before you start marketing your property and that the pack is valid till you sell your house. also that the mining search is completely optional. we are going to have to pay them as its the only way to get our sale through in time as we still have a 10% deposit mortgage for our new house and it will be worth the extra £180 lay out but i just want to know if what he's saying is true or not?

    Its up to the seller to have searches done initially, for the HIP. But when a sale it is agreed these are normally out of date! So then it would be up to the buyer to redo them if they want to. Or they can get an indemnity at the cost of approx £20.
    Its quite common for the buyers soliceter to try it on and get the seller to pay for these again, but most people would refuse to get them re done.
    However the cost is minimal and its silly to either lose a purchase or a sale over this, so it sounds like its a case of who breaks first!

    As said above, you dont legally have to pay for the new searches but the buyer may insist. After about 5/6 months most solicitors will want new ones. The only compulsory searches are the council and water, any others the buyers need is up to them. do not pay for the mining searches!

    mining search depends on where you live your solicitor would know how urgent this is for your area.
