Warranty Direct... another declined claim thread

Hi,

i am after some advice on how i can proceed with Warranty DIrect.

I had a ball joint replaced a couple of months ago on a car i have owned since October. The garage phoned warranty direct to get the go ahead for the claim and obtained a claim number.

The repair was done, i paid them £150 and filled out the forms etc for the claim. Took a copy of everything and sent it off. They claimed never to have recived it so i resent it all again, this time recorded delivery. It took them 2 weeks to 'process' it since receiving it and finally sent out a request to send them the service recipt. I had included a copy of the reciept in the pack they recived but they are claiming it is not good enough.

The car was serviced when i got it with 65k miles. The reciept has a hand written list of all parts used but no product numbers - WD want numbers, labour costs, proof of payment. There is no labour cost or payment on the receipt as it was serviced as part of the car purchase.

I have contacted the garage who sold me the car. They they say they are not able to supply a list of part numbers as they do not keep such records. Also, there is no record of labour cost or proof of payment as no money as such changed hands for the service.

The garage are also claiming that Warranty Direct are acting illegally when they sold the policy due to them not checking if i had the neccessary documents to make it 'active'. He kept quoting the FSA and how he deals with warranties every day and knows what he is talking about.

Can anyone point me in the right direction here?

do i have a shoddy warranty?

or have i given a lot of money to a shoddy car sales man for a shoddy car?

    All warranty companies work in this way.
    I deal with Auto Protect who want every last detail including inside leg measurement.

    The FSA is is there to make sure that you don't get sold a two year warranty on a car that still has it's mnfr warranty etc. Or you don't get sold breakdown cover if you're already with RAC etc...

    All warranty companies work in this way.

    Or you don't get sold a warranty if the car isn't serviced enough to make the warranty valid?

    As long as the most recent service was in accordance with the mnfr spec then yes.
  • thanks guys but any idea where this leaves me?

    i have a garage who cannot provide me with the information WD wants and a warranty company who are not going to pay out until they get what i cannot supply.

    Can i pursue one or tuther for the claim?

    I asked when i bought the car if it would be serviced to manufacturers spec and was told yes. now it appears the paper work is not up to scratch so surely that garage is at fault?

    Should i just give up now and cancel the DD for the warranty? i see no point in continuing to pay for a service that is not being honoured. can i try to reclaim what i have paid so far as clearly i don't have any cover and never did?

  • p.s. i realise the value of the claim is very small but it will be even more difficult should a bigger claim occur.

    Did the dealer you got the car off also sell you the warranty?

    If so then I’d say chase the dealer, they sold you a warranty which is invalid because they didn’t service it properly (or can’t document they did)

    If not then and you got it direct from the warranty company then I think you could be on your own. WD will argue (and I can see their point) that the servicing requirements are there to ensure that cars are roadworthy when the warranty starts and the responsibility from complying with the servicing requirements is with you.

    Having said that it does seem unfair that WD will not settle for written conformation from the garage of the details of the service and on that basis I’d be tempted to give the Financial Ombudsman a ring and see what they say.
  • unfortunately i did buy the warranty independantly from Warranty Direct.

    I will push it for a bit and see how it goes but i am really hacked off about this.

    It's the first car that i have spent a good deal of money on (over £5k) and first time i've bothered with a warranty. I thought i'd done everything right this time having run bangers in the past.

    One other thing I forgot to mention was how come you had to pay for the repair? Normally the garage doing the repair does all the leg work. I've never known a warranty company to do it the other way round.

    The way to look at it is: Would you pay to have your car repaired after an accident then claim it back from your ins company...?
  • if you use their 'approved' garages they do everything for you. I used a local independant therefore i need to pay it then claim back.

    There are only three approved garages in the edinburgh area and two of them are on the same street! not very well thought out.
