Claims stayed in court discussion

This thread is to discuss claims that are currently stayed in county courts waiting for the Bank Charges Test Case to end.
Remember you can still claim if you are in Financial Hardship.

  • I have started to read the article and I am disappointed with it. The Waiver was renewed in January 2009 and the only way to challenge that is via a Judicial review which Legal Beagles did get a legal view. That view was that it was not a viable option. You need to put pressure on the FSA to tighten the waiver, as it is due to be renewed in July 2009.

  • "Designated" consumer groups were consulted and the definition of that means that internet based forums were not consulted on the waiver.

  • Hi I have just been told by my bank The halifax, that they are charging me £28 for being overdrawn by 12p. My debit card doesn't allow me to go overdrawn and usually declines at the till. I cannot afford any of this as I am on income support. I have already asked the bank about it and they have completely refused to waive it, please can someone give me any advice? Jo

    Jo youve posted this in the wrong place. Re post on the Bank charges discussion thread, you will get more people viewing it there. In answer to your question, yes there is something you can do and thats go through the reclaim process, although you will need to start at the beginning and send them a letter with £10.

    All explained in greater detail on the reclaim tab up the top under bank charges reclaim.

  • Hi, Tell me I am not the only one and that I'm not missing a trick. I took HSBC to court over bank charges, by the time we got to court the stay was in place however as the solicitor for the bank didnt show I got the judgement :) however, they later applied for a stay and were granted it. I now have a judgement against the bank but no way of collecting. Am I missing something or do I need to wait until the test case finally gets resolved?

    Doesn't make sense with the bit in bold. If you had a judgement by default then they would have had to set aside the judgement to get the stay. Is that what they did?
