Hair disater

Hi there
I got went to a hair salon last week to get my hair highlighted, something I have done for 10 years now with no problem. Have had to leave it a while as I was pregnant, then has the baby etc, have a wedding coming up, then my own in 6 weeks, so needed to get it done. Went to the salon, stated I wanted blonde HIGHLIGHTS, she could clearly see the colour I already had. Anyway, once she had finished they were bright orange. After her putting on a toner they were just as bad, with patches and colours going on all over the place.

The next day I went in to complain, and spent a further 3 hours in there while they attempted to sort it out. This time I had bright YELLOW hair, no highlights, just all over bright yellow...this I didn't discover till I got home and my hair had dried. (naturally very curly hair, never let them dry it in the salon) May I add, they also did the worst haircut I have ever had, and chopped about 3 inches off too much, which isn't good with very curly hair.

So, I went back in the day after (after spending the previous night in a right mess) and she said she would have to speak to the manager about a refund.

In the meantime, I went straight to a top colour specialist in the city and it cost me £105 to get it colour corrected, and a further £35 for an intensive treatment as my hair was so badly damaged, and treatments that I have to use daily to restore it.

Do I have any grounds for refund/compensation here? I have pictures...so I have proof of what they did, and witnesses.

Any help appreciated.

Cheers.

did they do a skin patch test, or ask if your colour was natural
    Back by no demand whatsoever.
  • did they do a skin patch test, or ask if your colour was natural

Nope, no skin patch test was done, they also didn't ask if my colour was natural, but it already had highlights on the ends from when I last had it done. I know why it went wrong, she used a tint instead of peroxide...but this wasn't established until after the damage had been done. When I went back to get it 'fixed' they used peroxide then, but it turned bright yellow.

if they used tint, it would not have gone orange. They have not used correct amount of peroxide to developer to make it blonde not orange. common mistake in highlighting, did it myself once in college.
If the hairdressers you went to are part of a big chain, write to head offuce to get money back, although in this situation you only have the right to get it corrected until you are satisfied at the salons cost, no matter how long it takes or how much it costs them.

  • Whatever they used the first time round it wasn't peroxide, thats for sure.

I have already given them a chance to fix it and they turned it yellow!

I then went to a different salon (as there was NO WAY I was going back to them to mess it up a third time) and had it colour corrected by a specialist, so I have already spent money on getting it fixed and coloured properly.

I'm fine as long as they refund the money I payed to them in the first place, then pay the £140 it cost to get it redone and the products I have had to get to restore the damage it has caused to my hair.

All Im trying to establish, is do I have the RIGHT to claim that money back off them?

You have a contract with the salon to exercise reasonable skill and care when cutting and colouring your hair.

From what you describe, the salon is in breach of contract.

You are entitled to ANY loss incurred as a result of the breach of contract. This is not limited to the price you have paid for the service.

They should either put right their mistake or pay for it to be put right at another salon.

If you refuse to let the person who has twice ruined your hair have another go, that wouldn't be unreasonable.

You have every right to sue for the full cost of putting right their mistake(s).

similar has happened to me -Hails86 is quite right, the peroxide they have used has not been enough
i know you say they didn't use peroxide, but they probably mixed it with the tint and haven't used the correct strength of peroxide

once when I had mine re-done I was VERY blonde - luckilly my hair is short and I get it cut every 4 weeks, so within 8 weeks it was back to normal
in the meantime I used a blue malva shampoo and also old fashioned "silverdrops" ( like a purple rinse) diluted in 2 pints of water as a final rinse and it made the highlights more ashblonde than yellow

I would pursue the costs if I were you - my hair dresser was very good and gave me my next cut (£32) and my next cut and highlights (£65) free of charge as compensation.
He is an exceptional cutter, so i stuck with him!
