Creation Consumer Finance problem

I purchased a suite on a Creation Consumer Finance agreement from Land of Leather. Suite utrend out to be faulty and Land of Leather stated in writing it was unrepairable, and offered a refund minus usage charge. Before uplift was arranged LOL went into administration. Administrators will not sort out the problem, so I was told by Consumer Direct and trading standards Creation are jointly liable, so lodged a claim with them. However they are choosing to ignore all correspondence relating to the matter, both from myself and Trading Standards. Trading standards have advised I could take small claims court proceedings against them , but as the company are in Belfast, do not know if I would be able to get the money should I be successful. They have also advised not to withhold payments, as I will be deemed to be in breach of contract. I would have though by ignoring the claim, CCF were already breaching the contract.
Any suggestions, as I really don't see why I shouldl keep paying for a substandard sofa that CCf are jointly liable for.

  • I'm in a similar predicament... Bought a suite from LOL last August via the Creation Finance "Buy Now Pay Later" option.

    We discovered that the stitching has started coming away on one of the sofas. Phoned LOL the day before they closed down and they gave me the details for the administrators.We sent them a letter though it's been about a month and I haven't heard anything and the suite is due to be paid in August (Before they add their £600 interest charge !!)

    I'm thinking the same... How should I have to pay for something that is faulty. :confused:
  • I only got a phone call from Land of Leather's customer service department, saying that the administrators were not prepared to do anything, the administrators did not even have the decency to contact me themselves. No-one seems to be able to do anything, and it seems that ignoring my letters (and contact from trading Standards) is enough to get Creation out of having to do anything about the suite that has already been written off!. Looks like I will have to keep paying and keep sitting on a faulty sofa until the financial ombudsman get around to reviewing the case, which could be many months from now. I am absolutely disgusted that despite supposedly being covered by section 75, the company can just ignore the problem.

    I can relate to the frustration caused.. .Wish I'd never bought the thing. I've got a guy coming out tomorrow from LOL to have a look at it. Though what I've read on here I'm not holding my breath on a satisfactory outcome. It turns out a woman in my work has exactly the same suite & problem and they said that as it was the side panel of the cushion it was leather "match" and the insurance company wouldn't cover it.

    Hopefully as I'm still under a year old my case still lies with the administrators. I did contact Consumer Direct and they said that the finance company "Creation Consumer Finance" could also be joint liable.

  • Hi I have been waiting since Jan 09 for LOL to sort mine out too this is the second suite which had the same fault as the 1st, after several months of phone calls now been told LOL will not or cannot do anything and I should goto my fiance company I paid up before interest was put on. But as I was in my second year effectively I should call home serve to see if they could do any thing, but as it was a replacement suite and was covered by the manufactures warranty they were not the ones to repair it. (Run around begins again) now I have to call creation again and write explaining what is what!

  • I too am in the same situation as I bought my sofas in august 08 on a 'buy now pay later'. Love the leather sofas but they arrived with large scratches on, the delivery driver noted them on the delivery note and said he would speak to head office on his return. I phoned them several days later and they had no such complaint, so I complained and they said they would send somone around (Jan 09). That never happened and trying to get in contact with them has been a nightmare. I have lodged a complaint with LOL, CCF, and the financial obusman. I have just recieved a letter from LOL administration saying that they cannot provide the standard 1 year warranty and have attached a 'proof of debt' form so that I can claim against the company. I have run into my 12 free interst period so the CCF interest has been slapped onto my payment so instead of £1799 its now £2404 which will increase to £3400 at the end of the term. I have been told that it is better if I keep paying the monthly installments as it means that the finance company will still be liable and it will be more likely for me to claim against them. Not sure who to speak to now and how likely I will t anything through the 'proof of dept' form.
  • i also have a faulty couch from land of leather after 9months i noticed a few rips in th leather creation wudnt do anythin about it so i refused to pay they have now put a load of interest on an r takin me to court i am gona take all my pics with me an hopefully i will win i believe a couch should last years not months

    I have successfully sued CCF in an english county court and got judgement. Alhough CCF are in Belfast and nominally outside the Court's area, you can complete an additional form which allows effective service in Belfast, I can find you the details if you require.
