Injury claim / admitted fully- help?

    I agree with SolicitorMidlands. You need to instruct a solicitor to deal with this for you. Without any specialist legal training you're not going to be able to establish what a suitable offer is here. The figures that geri posted are taken directly from the JSB Guidelines, which is the starting point for valuing an injury, but it is far more complex than just pinpointing your position on that list. You need to instruct a solicitor to examine this case in detail to ensure that you get the best result.

    I am just a bit worried about the fact that they on there last letter say " we have reviewed our files of papers and consider our offer of 3k appropiate on the basis of the medical evidence- therefore not prepared to ....."

    no where does is say the humiliation in front of 30 guests at my house or the ruining of a 2 week holiday with a "dead arm" nor the fact that I can not play rugby untill it heals which is anything from 1 -2 years

    Is there any reason you have not instructed a solicitor? How do you know whether any offer is enough?

    My advice would be to instruct a solicitor ASAP.

    That's just standard wording for a letter of that nature. There's nothing to read into it. But to be honest, what you've posted there is exactly why you need a solicitor. You don't understand the process, and as such you're going to misinterpret things like that and be constantly struggling with procedure that you simply have no reason to know anything about. You need an objective and legally trained pair of eyes on this case that will work in your best interests. You're putting yourself at a disadvantage going it alone.

  • my mother in law was also injured by one of these hammocks. when it collapsed the post came down and severed her nose. she has since had sight problems which we belive were as a result of the accident. her claim is still going through nearly two years later.
  • I can't see how you can have piece of mind doing it yourself either. You don't know what you are playing with so to speak.
