Should i have to pay charges, or wait ??

Hi Guys, this may have been bought up before, but i have requested all my previous bank charges be refunded, this was a long time ago, and was told that have to wait for the outcome of the courts decision on unfair bank charges.
Anyway, i got another bank charge for non payment of direct debit, now should i still have to cough up the fee? or tell them what they tell me...
to wait until the outcome of the court?!?!?!
