You want something that says he admits fault but you are quite happy to accept £500 (or whatever) as full and final settlement in respect of damages incurred on date.

    Don't over complicate the issue.

Hello James, i went through the same thing about 5 years ago. I accepted a cheque for £500 as the other chap did not want to go through his insurance. I asked that on collection of cheque he would have a reciept written out for me to sign stating he had paid me a cheque for the sum of £500 for damage to my car and to say i had recieved it as payment in full. I also made sure he signed it too, along with his name and address on, i also explained if the cheque didnt clear i would go through the insurance.
I do hope all goes well for you ;)

    Say what now?

If it is a cheque just make sure you get a signed statement, But to be fair to the other party they seem to be pretty accommodating. Hope all goes well.

You sign a statement that has both of your names on it which states I (Mr J Bloggs) pays Mr J Smith the sum of £500 in full and final settlement of the accident that occured on the 11th April 2009.

    Signed (By both people)

(If you want to be very through you could get someone to witness is, if you do this put their address next to their name and signature)
