boght prom dress wiv credit card now internet site gone wiv dress and £180

can some one help please on march 10th i bought a prom dress for my daughter i paid by my credit card but we havent received the dress and the site disapeared what are my rights?? my daughters prom iss in 3 weeks and ive lost £180 can anyone help thanks

    You need to make a claim under section 75 of the consumer credit act in order to get your money back, contact your credit card provider and explain what has heppend and that you want to make a claim, they will send out a form for you to fill in to get your money back.
    Good luck and I hope your daughter gets another prom dress in time.

    Ill give you a little help i work in the Disputes Department of the bank.


    People spouting of section 75 bla bla bla its nonsense. When we are dealing with problems such as non receipt of goods. its very very simple.

    you MUST have tried to contact the merchant to resolve the issue and this has to be put down in a letter.( you said merchants website has gone, print a copy of the page when you search for it and detail this in the letter.)
    Invoice for the item would be good, however not essential a description of the goods would pass.
    Expected delivery date is essential, unless you have bought the item recently. Have 120 days from the transaction date to assist.( or if you have a delivery date that can be extended 120 from expeceted del date).

    Once the above is in takes 2 seconds to charge the transaction back to the merchants bank and credit your account.

    Very interesting to describe section 75 of the Consumer Credit Act 1974 as 'nonsense'. It's actually the law which people are 'spouting'. Please see the below link for more information.

    I didn't think gnaril was saying it was nonsense per se, just pointing out that simply quoting the rules is less helpful than when you tell someone exactly how to work them, such as exactly what to quote in the letter? :confused:

    It was a poorly constructed sentence then! Card companies have a reputation of attempting to shrug off their responsibilities when it comes to consumer law - the OP needs to know her rights, just incase they try to explain there is nothing she can do. Different issuers have different rules and procedures, I have never waited 120 days or had to print off search results when claiming a refund for a failed internet transaction, just one example. The OP needs to contact her issuer.

    They hate it when we, the consumer, tell them the law and you know why we do it? Because they have skanked us for that long that they think we'll still roll over and let them tickle our bellies, like we have done for years before, when in fact the average consumer has gotten a lot clued-up and will now quote acts in the hope the banks realise we do know the law and we do know our rights.

    For instance, you can't tell me some fresh faced college kid knows all about section 75, or lets throw in section 10 DPA and confuse matters by quoting acts from the FSA and DPA mixed in with some ICO rules and regs. They wouldn't have a clue so my point is that by quoting the relevant act, the young spotty faced student that has no idea what a section 75 is (its not an asbo either!) will hopefully realise this is important and pass it over to someone with more nouse, so to speak.

    Ultimately dealing with the original complaint, appropriately.

    Go to the card company with the required infomration which is what is needed for Mastercard for a chargeback, just trying to save you some time. If you provide them with all the inforation in the 1st instance it will save them chasing you for further information or ( you havent provided me this than and another.)

    The bank will NOT just give you the money back on the card or key a chargeback without the required evidence as per Mastercard/Visa regulations. the fact you quote section 75 makes no bit difference to the issue at hand.

    The card company arent shrugging off anything, if there is enough information for a chargeback it will be done, what benefit are they gaining from it, the original payment gets bounced back to the merchants bank. The bank you hold the card with gain nothing....

    Sorry but i work in the bank and people read these boards and think they know everything and take the high line when there is no need for it. You would be suprised most bank staff at basic level are actually ok, you only get the odd few idiots.

    Oh and swizzle your reading the post all wrong. 120 days i mention basic terms means that if you have an issue with your purchase on your card, the bank have 120 days from the date of the transaction to key a chargeback as per the regulations. Thats why we have to unfortunately at times have to tell people we are unable to assist with certain issues.

    Anyways getting off the point. was just trying to provide some helpful advice to get the OP money back asap.

    You keep saying you work 'in the bank'. There is more than one bank in the UK and many card issuers with different terms, procedures and policies. Many issuers of premium cards offer payment insurance, removing the need to perform some of the tasks you describe. I personally think you are taking the 'high line' based on your limited experience. You assume that I or never-in-doubt are merely consumers but you could be wrong, in this case you are. Instead of assuming I read the post wrong, perhaps you constructed it in a poor fashion - for instance it reads to me that you expected the OP to wait 120 days before making a claim rather than the fact your company have 120 days to perform a charge-back.

    Please contact your card issuer ineedhelpasap2009, with the knowledge you will be entitled to a refund.
