Dealer sold me a CAT D Write-off

    and your car was only worth 45k when damaged not 84k.

    I beg to differ with you but the cats are down to a % loss. All mere figure with the insurance companies and nothing to do with the value of the car on its own.

    I didnt say it was worth £84k when damaged... merely trying to make the point that uneconomical to repair can mean £1k of damage on a cheaper car or £20k on a more expensive one. Im not here to argue about this, im asking for constructive advice on chances of winning a case where I've clearly been sold something that was misrepresented.

    Sell it then claim for the difference between that and what the dealer would have given you if it was in good condition.

    Can you confirm the full model and spec of the car you bought, the age and mileage.

    What has MOT got to do with cosmetic damage? new wings, filler in arches, panel gaps, wing mirrors, bumpers.. are not on an MOT check list, the crack in the engine bay is also well out of view.

    I didnt say it cannot be sold to anyone? I said dealers dont want it cos its a write off, private sale different story... but id be looking at £12-£14K max.

    Im not exaggerating anything.

    I cannot confirm full details as this could quite easily be read by the defendant.

    You are clearly at it.

    Firstly what difference does it make if the defendent sees it if you are telling the truth and have the case you claim.

    Secondly. MOT's check the cars structure and such, if it was dangerous it wouldnt be on the road, also if it was as badly damaged as you claim its totally unrealistic to say that it wouldnt have been noticed or had an impact in the time you had it.

    Thirdly how many garages have you actually tried to sell it to or trade it in at? Also if you can get 12-14k private then you should sell it and claim the normal trade in value - 12-14k. You have a duty to minimise your losses.

    My impression of you and probably any judge will be that you have had the car for 6 months and instead of paying for depreciation yourself you want the trader to give you a whack over what the car would be worth.

    I am no legal expert - Joe Average - so wouldnt know whether it has detrimental effect on case if defendant sees it so keepin on side of caution.

    your impression of me?

    1) Buyer purchases a car stated as HPI clear at top notch price using life savings
    2) Car isnt HPI Clear as stated in advert and trader says tough luck

    What part of me is at it? I couldnt care less about depreciation, I'd take that on the chin, afterall if i was thinking of a "new car fund" as you say, depreciation has hit that too, so no issue, but depreciation due to cat D is something that I cannot swallow.

    Selling it for £12k is not an option, I'd rather break it.

    What do you mean when you refer to as the "trader". A garage or a trader out of the private adds.

    Most would only trust an HPI certificate from a main dealer and would have done all the relevant checks first before paying out our life savings.

    By the way what car is it, I'm after a two seater for the summer.

    An established vehicle trader - garage.

    We live and learn, but you'd hope that if a car is described as such and provided with the certificates to back it up, thats enough to go on, since its a dealer..

    I'm not selling it matey, for what i'd get for it, its not worth selling.

    It isnt enough to claim 54% though.

    You need to sell the car and claim the difference, to claim 54% and keep the car is utterly unbelievable

    Unless you become far more realistic you will be laughed at
