    No - it would be illegal to sell used goods as new.

    Returned goods might be unused as as such there is nothing to prevent a company placing the item back in stock.

    But this item had been used, the OP had the evidence.

    The item should have been sold as " used " not as new.

    Agree with you but I think Phlogeston was making the general point - not about this case in particular.

    In your case OP, I would be tempted to track down the first owner, from his postcode, surname etc, out of curiosity, to see if they had returned it as faulty (therefore still faulty or 'graded goods') and so they are aware that Currys resold the TV with his details still on it!
