Sorry I've been quiet here, there's been absolutely nothing to report...
The Pension Service have now responded to the letter DH sent them. It's short, sweet and to the point; in essence they paid so go away!!
DH is going to sit down and compose his response later, something along the lines of "But you didn't pay the deceased and I can prove it, now look into it and rectify it".
Still waiting for NS&I to get back to us regarding how much is in that account.

Ratty - thanks for the update. I suppose the DWP is understandable - they paid into the lady's bank account and it's not their fault that someone spent it. However, we know it's slightly more complicated than that.
Good luck to Mr Ratty, I bet this isn't the hobby he meant to take up......................I'm smiling because I have no idea what's going on ...:)

Errata, I think there maybe a slight misunderstanding here...
The DWP state they have paid the lady's state pension and winter fuel payments to her up until she died but the bank statements show no record of this happening after 24/10/2005.
The DWP have now confirmed via telephone that an instruction was received in October 2005 to change bank account details. The bank account number they have on file does not match any of the three accounts the lady held (yep, we already knew that one!!)
DH is persuing them as they clearly have not taken due care when altering who the money gets paid to. The lady could not have authorised this change, she was in hospital in a 'profoundly confused state' and had been since 10/10/2005.

Apols Ratty, I did indeed misunderstand. I had some difficulty with the DWP a while back as my stepdad is extremely deaf, can't use a phone, and asked me to phone them for him. They wouldn't discuss anything with me on the phone citing data protection as the reason - quite rightly. He had to write to them, and in the letter gave his written permission for them to talk to me on the phone.

I can understand what you are say but unless the DWP are aware that the customer is unable to handle the affairs then they cannot arrange for somebody to be appointee, which would of happended in a visit with local office and if it was shown that the daughter was not appropirate person, then an alternative would of been arrnaged. A customer in hospital does not mean they are unable to handle their affairs. Crystal balls are not provided and I wish that they were it would make the job a lot easier. (yes I work for DWP)
And yes, I would like to do something to the daughter as well.0
