no claims problem - swinton, fsa guidelines?

well my insurance got cancelled as it defaulted, such as my financial state...,
so i took out new insurance with a different company who are obviously wanting proof of my no claims, problem is swinton wont release them due to my owing them money, i called my new insurance who say they cant do this due to fsa guidelines is this true? i also called fsa who are going to get back to me whenever there call volumes reduce so that could take forever, hence me asking here to see if anyone can give me an answer faster, thanks

I seem to recall that Swinton are allowed to withold it if its due to non payment based on responses on previous threads that have said the same.I am an Independent Financial Adviser (IFA). yeah i told my new insurer the details, it was them who told me they have to release the NCB as its the FSA guidelines, ive yet to hear back from swinton or the fsa on the matter but i will let you know the outcome, regardless of the answers i get on the forum (not being ungrateful i know it comes across that way)
just off the phone to swinton and there saying they can withhold...0 -
under the data protection act you have a right to certain information, ask them to provide this information under the dpa, they have a right to charge £10 maximum..... i would do this....what do other people think0

Check your new company doesn't require any minimum NCD from you, or this failure to provide proof could result in another cancellation.0

i was considering the data protection route as i have proof from my old car and if i could prove i haven't had an accident since then then i would be ok, but this morning i done some searches through all the comparison sites and got one the same price as i have now with no NCD, but better still the cheapest company called me, i explained my situation and they said they would accept proof upto 2 years old which i so happen to have so i may be looking at further reductions again

As far as I know most insurance companies do this. Until you settle the balance with them, the bonus you gave them can be legally held, regardless of what your new company tell you.0

Also, on your last post, that 2 years bonus proof is invalid, as only Swinton have the right to release that as you surrendered it to them when you took up that policy with them.
As far as I am aware off. Elephant admiral direct line etc will do the same.0 -
Under the ABI guidelines the no claims bonus is the customers and cannot be witheld by the Insurer. Obviously the FSA have taken over now and its very very difficult to find info on their website. I would assume they would have followed the ABI's guidelines on no claims bonus as they tended to take on most of the ABI's guidelines and either keep them as they were or make them even more customer friendly.
I woudl suggest you ring the FSA and ask them what their ruling on witholding no claims bonus is. If they rule they cannot withold it then you can ask Swintons to release it.
P.S You will need to pay Swintons what you owe them as some point if the amount is valid and owed0
