Cerditors starting to chase - what do i say?

Hi again,

ive just had the second call from Picture in 2 days this time from a very agressive sounding woman asking why i never called them back yesterday, honest answer is i forgot, ive explained i will never go through security questions from calls i recieve but i think i need to get things settled,

as ive explained before im currently planning on voluntary reposession and therefore i am saving up a deposit for a flat and for BR which means i need about £1000 which will take me another 2 months to get so in the meantime ive had no choice but to not pay my mortgage secured loan or other non secured creditors.

my question is that with them chasing me do i just explain to them that im currently saving up for BR and in the mean time i cant afford to pay them?

from my current understanding i would still have to pay my secured loan & mortgage even when BR should i want to stay in the house in which case would still mean paying an extra £200 a month more then to what i could get a bigger rented house for.

i was initially hoping to wait for a couple more months until i had all the money together but as it stands im tempted to move out sooner and save up the BR payment slowly but i feel this is just delaying somthing id like to get out the way.

im going to give the debt advice line a call and see what they say but i thought i should ask you guys/gals too.

    Tell them if they ask your currently seeking financial advice from cccs/national debtline etc & will be in touch shortly....

    DON'T tell them you are saving to go BR, that will likely make things worse. I know it's easy to say, but the key thing to do really if you are absolutely sure you are going bankrupt is to just ignore them. If they know you are going BR, they are likely to increase the pressure until you get so fed up of them you either pay, or they come and take stuff.

    I've been ignoring my creditors completely for about 4 months now and only yesterday did the first one show up on my doorstep, before which I had plenty of warnings of visits so don't fret, all will be ok and by the time you know it, you will be able to go BR and put it all behind you.

    I would just say you are taking advice. Thats what I was told by CAB when I was waiting for my appointment with them. Put that in writting if you feel you need to. They can't take you to court if you are communicating with them.

    ive just spoken to the national debt line and they advised me to explain the situation to both parties, i.e. tell picture im currently saving for a deposit for rent as i cant afford the house and plan to give the keys back to northern rock in july and tell northern rock the same.

    they said that pre action protocols ensure that they cant start reposession action until i am 3 months in arreas which will be early july and that it will take at least 3 weeks from that date before i am due in court, if things stay as planned though i will have the money for rent etc... on 28th of june and worst case scenatio is that i get the house repossed and end up in a council house for a short while till i get the rent sorted.

    i dont really think this will help as i know picture are the ones that will be losing out but as picture themselves went under they should be understanding

    this is a rollercoaster ride indeed, ive just spoke to A&L, one of my unsecured lenders, and explained the situation she instantly got very abrubt and explained that they will send out a final demand in the post today and will look into placing a charge against the property and i will recieve a CCJ, i said i was willing to make a token payment and she refused to accept anything less then what the DMP was set up for. at this point i was annoyed so just said "OK cheers" and she hung up.

    with me taking volentary reposession will a charge against the property even matter? my main concern is the CCJ what does that do to me?

    gtanny We are in the same position as you hun, my OH is planning to go BR, we had been planning it for a while but the icing on the cake was a forgotten debt that came through the post for OH to the tune of £9k we already have a DMP in place for his other debts and mine. The thing I want to know is, the debt of £9k has not been added to the DMP as OH is going to go BR anyway, but we have already had the second letter from Horwich Farrelly solicitors for the £9 owed, (they have taken the debt on behalf of Liverpool Victoria) so do we call them and tell them we've received the letters or just leave it and wait and see? :confused:

    Do not say anything to them! Sorry but if she tries to get a charging order, that will effectively secure the debt against your property and will not be part of the BR.

    Stop digging yourself a hole NOW!

    So you upset this delightful creature by neglecting to call her back - do you think she was sitting there weeping? It has basically now set the timer for bomb, you have given yourself eight weeks to get everything together and go BR - you have to find out how fast they can get a charging order.

    I don't mean to sound harsh but please, please, please stop digging now. I hope I am wrong with this.

    Oh, i do hope you are incorrect but it would be a big problem if this was the case, even though i am choosing to allow the property to be reposessed i take it this will still carry over with me then?

    im glad i have this advice now and not after i had told my other lenders

    ill give the debt helpline a call and see what they say

    Would that be the same propert that gtanny is letting go :confused:

    If so it wont be secured for long, even if they can get it through, before BR, and once the securety is gone it will fall into the BR

    If you go BR then a CCJ means nothing
