Does OR call DVLA?

my ex gf bought a car last year .she payed for the taxroad ,insurance ,and the car as well
the thing is the day got back to pick up the car from the seller .i put my
name and adress and then we get the v5c logbook in my name . i suppose to change long time
ago in her name but stupid me the time past and get busy and forget...
today my ex gf not living with me and i about to bankranpcy cause i lost my job.
and go near the car section in the applicatiopn remind me the matter above and get worry
WHAT SHOULD I SAY TO THE OR?
--if i say i dont have a car. does the OR check with DVLA ?(like routine chech in every
one go BR)
-is it to late to transfer the car in her name?
will apreciate if anyone can help..

    Yes I am pretty sure the OR will check with the DVLA to see if you are the registered keeper of a car. However even if you are listed as the registered keeper, as long as your ex gf can prove that she bought it, she shouldn't have any problems.

    I am assuming she is the sole user of the car now even though it is in your name?

    Definitely don't transfer it to her name - it looks dodgy, like you are trying to transfer an asset. Just explain the same way as you did here, and have the paperwork to prove your gf bought the car.

    thats not actually true anymore, i am the registered keeper and legal owner of our car, but the insurance is in hubbys name with me as named driver. and the insurers are fully aware of this and it is stated on the policy that he is not the keeper or owner.

    Im sorry but that was wrong of your OR to do so, the registered keeper is not the same as the legal owner, if your ex husband could prove he held the bill of sale, and can prove the funds came from him it was his property so nt an asset of your estate

    You had no need to prove it was exempt in such a case

  • 31.2.2 Establish ownership

    Any motor vehicle owned by a company in liquidation or a bankrupt (the insolvent) must be dealt with proactively. Vehicles are a source of potential liability and must be dealt with at an early stage. The official receiver should establish the ownership of all motor vehicles the insolvent has use of or which are kept at the insolvent's premises before taking the appropriate action.

    A vehicle registration document showing the name of the insolvent is not proof of ownership only proof that the insolvent is the registered keeper of the vehicle. This is however usually a good indication of ownership. In cases of doubt additional evidence of ownership should be obtained from the insolvent and interested third parties regarding the source of the funds which paid for the vehicle or any contract under which the vehicle was purchased.
