On the 4/4/09 I ordered a bed from Asda's online service which was processed and the money withdrawn from my account. On the 6/4/09 received a phone call from Silent night beds arranging delivery times. At 10am on the 7th I received an email from asda explaining the bed I had purchased was no longer in stock and the money would be refunded to my account and the order was now cancelled, and when I phoned customer services they reiterated the bed was no longer in stock and was discontinued. I then received a phone call from one of the directors of Silent Night beds informing me that Asda had cancelled the orders from customers for 180 of these beds which ARE in stock and were awaiting delivery. I am currently, and have been waiting (3hours) for a callback from a customer service manager at Asda's helpline.

I am wondering what are my rights in this case and what advice anyone could give me.

Thanks

- just found this - Silent night bed on quick grabbit page - which the director of Silent night mentioned. (cant post links as a new user) They have been left with a large bill from these two companies, but what chance is there we will get our beds? or any other compensation?

  • Your contract is with Asda, what silent night say is irrelevent.

Asda likely have decided not to restock due to the terms and silent night are trying to force them into it by calling customers.

    Arguably breaches of DPA too.

And compensation for what? what have you lost?
  • What have i lost? I do not have the bed that i have purchased. Therefore i have to find another one. Although the money has been refunded, the special offer has been removed, meaning i will have to pay more, and furthermore it's pretty inconvienient for me.

So i'm guessing from that response you're saying there's nothing that can be done, i'm just out of luck?
