    If liability was never accepted why did you get a settlement of £4500???
    Liability was denied by the driver as I read it as he said he was never there, and as such the claim was settled by the MIB. But even if they denied liability as well, it is not unusual for a party to deny liability and then put forward an offer to settle the claim.

    The thing that worries me the most here is that the car hire charges should have been included in the amount claimed, both from the third party and the MIB, because it forms part of your loss. It's possible that they have, but then obviously the settlement for the car damage would have been relatively much less. This is certainly something that you need to clarify.

    In the mean time though you also certainly need to get a breakdown of the hire charges and find out exactly what you're being charged for. Hire companies do not have the greatest of reputations in recovering outstanding bills. Many overcharge in a somewhat shameless fashion, and you should be aware that interest and increased charges can (and no doubt will) be applied if this bill remains unpaid for any length of time, which is why you need to make a move on this sooner rather than later. You'll find that the hire company will be more than willing to sit back and be relatively quiet whilst the charges increase. So get on to them as soon as possible and find out what exactly you're being charged for and at what rates.

  • Does no one else think 4.5k for a 7 year old punto in 2005 seems very high.

    I am going for him already having been paid out for the car hire and having spent the cash rather than paying the hire off.

    i dont fully understand that sentence, but still have £2500 from that payout as it was only last week. i used some to pay my current car insurance in one go. I didnt want to risk doing anything else with the money incase they said it was a big mistake and asked for it back
  • Whats not to understand?

    I strongly doubt your car was worth 4.5k, more likely that was the overall value of the claim including the car hire.

    I.e the car was valued at 2k and 2.5k to the management company expenses
  • Why on eath did your solicitor not include this in your claim to the MIB? They should have included it in your claim for special damage. Return to them and ask them why not.
