Constant calls from creditors to mum in law!

Hi there my OH has just rang me from work to say that yet another phone call has been received by his mum! She has been getting calls almost every day from a creditor asking for his address and telephone number, she keeps saying that she doesn't know either but they still keep calling! The one she received today claimed to be a solicitor and asked for a contact number for my OH! She is a pensioner and is getting quite stressed out by this, she doesn't know that my OH is going BR yet so she is worried about him now. meanwhile what can be done about the constant calls? Thanks for any advice given.

I was getting this with several calls being made to my sisters house despite the fact I had moved out 3/4 years before, I called and complained and shouted etc and the idiots still could not update the number! So in the end I had to make an official complaint through the Customer Relations department of the company concerned about harassing a third party. If I can find it, there is a good letter which you can send but I think it does mean that your OH will have to call them first and kick up a big stink about them harassing his elderly mother and get him to lay it on thick about the distress they are causing her (which is true) and that he intends to make the matter public through watchdog etc unles they update their records immediately and stop the calls.

will see if I can find the letter.

    Dear Sir / Madam

    Re: Account Number xxxxxxxxxx

I am writing to express my serious concerns regarding the telephone calls that I have received from your company.

I am now formally requesting that all further correspondence be made in writing only.

I demand that these phone calls stop immediately. I am familiar with the terms of Section 40 of the Administration of Justice Act 1970, and the Protection from Harassment Act 1970 and I believe your harassment places you in breach of these acts.

If you continue to call, you will also be in breach of the Wireless Telegraphy Act (1949) and, as such, I will report you to both Trading Standards and The Office of Fair Trading.

Take further note that continued telephone calls after the receipt of a request not to call may constitute a criminal offence under Section 127 of the Communications Act 2003.

You will be deemed to have been served notice of my request and I will deem it served by FULL DATE, I am advising you that any calls received after this date will be recorded with the intention of them being used as evidence.

    Yours faithfully,

***one thing to remember just type your name DONT sign it as some compan ies have been known to scan the sig & use against you**

All of the above from Phil! Thanks Phil. :D You can adapt the wording so that it applies to your oh's mums situation.

It doesn't sound like they want to give his new address/phone number though...
Just because you made a mistake doesn't mean you are a mistake.
  • That's the way to go. I have written direct to the CEO of a couple of companies threatening legal action on the grounds of harrassment - They soon get their house in order.

yes i know, to be honest, I didn't particularly want the calls but I did give them my number. since we had caller display I would ignore the calls until I got really really fed up of them and I changed my number and made it ex-directory so that they could not call me. :D

We don't Drea. We are literally just in a limbo atm my OH is going to make himself BR but we have to call CCCS first and do another review so we know where we stand then we can fill in the creditor part of the forms. But meanwhile we have been told to try not to answer the phone, and to literally "fob" the creditors off (for want of a better word lol) Until BR date. Really I could do with something simple MIL can say to put them off for now, (she's lovely bless her but hasn't got a clue what to say, and she may get it wrong if it's too technical) bare in mind she knows nothing of her son's BR plans. Thanks again x

Give them this number if they ask.

    020 7211 8000

That is the number for the Office of Fair Trading. :)
