Can I own a car whilst being an undischarged bankrupt?

    Ok what if his mom retrieved a bank statement for the time when he bought the car stating the same withdrawn amount as he paid for the car. Would that suffice do you think?

    Be worth a try.....you could always ask although the bank statement would show cash coming out the OR would argue the cash could have been used for anything without seeing a receipt for the car purchase.....could you not provide the statement & a copy of the ebay page?

    Couldn't show a copy of the ebay page unfortunately as we bought the car before the auction ended anyway and so the seller removed the listing early.

    Now this strikes a chord with our predicament. My OH will be making himself BR soon, but is extremely reluctant to lose his car, now he had an accident in November 2007 his car was a write off, his mom gave him the money to buy another car (to the tune of £1600) as it was going to be a while before he got his payout, the payout was eventually £3,100 but his mom refused the money we offered to pay her back for the car so we used the money to decorate the new house we moved into and carpeted throughout.
    Sooooo would my OH be able to keep his car on the basis that his mum bought it for him? Thing is, the car was off ebay, my ebay, and the lady we got it from finished the listing early as we offered her the cash when we went to see it so there would be no documentation. Where does he stand? xx


    Only thing you have to watch out for is that when you received the £3100 that you were in a position to spend it
    ie... OR will want to see why it should not have gone to your creditors and that you were not overstretchd at that point


    Without a papertrail & with him as registeredowner /keeper from purchase OR will treat it as your OH's
