Yes Car Credit

I had a finance agreement with these horrible people a few years back, I ended up giving the car back halfway through the agreement and had to pay off a huge chunk to get me out of the insurance policy, when I first got the agreement I was told the ppi was essential and I wouldn't be able to have the car without this insurance, my question is can I claim back this money and where would I start if I no longer have a copy of the credit agreement, I understand they are no longer running as a company.

    And yes if you were mis sold this for any reason then you go for it.

    Agreement wise - write to them and enclose a small payment of £1 postal order or cheque payment, they should supply this to you free of charge, any problem, let us know.
    However, they only tend to keep your info for about 6 years, but try anyway, you should be fine if within the last 6 years.

    In regards of reclaiming, you can still continue to write to complain, with your reasons, you will find some useful info here with templates:

    Keep on at them, as they may try to fob you off, so another letter maybe required, you will or should find stage 2 template letter on the link as well.

    They have 8 weeks to respond in full, and post all letters to these companies by recorded delivery for your proof of posting.

    If they are not running any longer, if they liquidated or dissolved, you could contact the financial compensation scheme (FSCS) to see if they have the company on the list, I would check first, or maybe contact the financial ombudsman scheme (FOS), who may offer to check for you, do this first before writing to them hun, and please let us know so we can try to work out something else.

    The finance provider was Direct Auto Finance and they are still in business.
    As the loan is no longer current I would suggest you SARN them as the Section 77 of the consumer credit act with a £1 fee will not be useful. You will have to send them £10 under the data protection act. The lender will have 40 days to respond.
    As long as the loan was redeemed in the last 6 years you should be able to retrieve all the information you require. You will find a SAR template on the site somewhere. If you have difficulty come back to me and I will provide you with one I prepared earlier
