Islington PCN - technicality question

    still think best to clarify signage first though.
  • Thanks for clarification, Neil - I went looking for PFC forums, and found the Persian Football Center...I was fairly sure that wasn't what you meant! I don't quite understand what you mean when you say 'don't jump the gun'? I certainly won't be missing the deadline, not with the amount of money at stake!

  • I'm about to write to the council to appeal, but thought I'd run what I plan to write past knowledgeable eyes:

    "If I have understood the information on your website correctly, Contravention Code 01, which is detailed on the above PCN, is parking on yellow lines. I have no recollection of parking on yellow lines on the stated date at the time given, so I must ask to see your evidence of such a contravention. Thank you and regards."

    Is that OK, or should I add something else?

    I don't think you've mentioned any dates. What is timescale?

    Pics of that bay may have been useful.

    Appeal seems ok but replace 'no recollection' with 'did not'.

    Also I don't see why you can't query service of the PCN if you believe something was dodgy.
    maybe approach that by querying the date of service on the PCN and point out that no PCN was served that day but appeared on the vehicle the following day. This is where you ask for the CEO's notes as well.

    I also wish to query the date of service of the PCN. It is dated xx April, but I did not see it on my car that evening. I believe that the PCN was served subsequent to the supposed contravention. This would suggest that the Civil Enforcement Officer obtained my address details and then crossed into a neighbouring borough in order to serve this notice. I would like to see the Civil Enforcement Officer's notes.

    Thank you and regards."

    I thought at one point earlier you expressed some slight doubt as to where exactly you parked?
    If you are sure you were in a bay and there was no yellow line running through it then I agree, pic not needed.

    Draft looks fine.

    On the served later bit - I now realise you are saying served in a different location as well?? I find it very unlikely the CEO could trace the car in that space of time. Or that a CEO has access to that at all.

    I'm unsure whether you should include now - kinda dims the credibility of the appeal. Maybe just ask for CEO notes, that should be enough.

  • I live very close to the site of the alleged contravention, but just across the borough line. I'd have thought they had access to the DVLA database at any time, day or night? They had the whole night to track me down! I'm sure the PCN wasn't on my car when I returned to it, but it was there the next morning, so I'm at a loss to account for that. I'll leave it out anyway. Thanks for all your advice.

    How you proceed is ultimately up to you. Include if you think so. It's not a techie issue - just a common sense view I was offering there.

    islington do have a direct link to DVLA, you are correct, but for that to happen would involve complicity on the part of back office staff.
    Islington did actually sack at least one CEO in last 6 months.

    i think the evidence you have requested, pics and CEO notes should have it covered. If there is anything dubious in there they may string it out or surrender quickly - but ultimately surrender if faced with the prospect of the Adjudicator seeing something dodgy.
