New car ordered, now being messed about

Hi everyone.

I have ordered a new car from Autofinders (bakewell).
I ordered it for delivery 04/03/06, so I could collect it the same day I hand over my old car 04/03/06. Saturday is also my day off, so I dont need to take a day off work.
They also stated that delivery day would be 04/03/06 on the order form.
They then rang me this week to say that delivery would now be delayed until Mon 06/03/06 midday, which now means I wont have a car to fetch new car, and I will also have to take a day off work.
I have now booked a days holiday, and paid a friend to take me to Bakewell to pick up car.
I have had another call now stating that if they get any further bad weather, it maybe delayed again.
Autofinders are a car broker, and refuse to deliver my car free of charge because of the heavy discount in what I am paying for the car.
With the threat of bad weather, and other unforeseen circumstances, this could carry on for ages.
I will also have no car to travel to work.
I have only paid £500 deposit thankfully, and the rest upon delivery of car.
Do i have the right to withold any inconvenience money ?
or any other claim due to being messed about.

Thanks

  • hmmm tricky one.

I see where you're coming from with regards to being messed about but on the other hand you do want your new car to arrive in one piece... which it might not if the delivery guy presses on in the snow!

    What are you getting anyway?

Unfortunatly when you pay Autofinders your £500 deposit they give you a delivery date which is subject to change. They cannot be held responsible for the delivery date and it can change. If it does change they are not liable for any inconvinience that it causes you.

If you really wanted to i know they do offer a delivery service, it will cost you a bit more but weigh up the pros and cons. If you withold any payments then you are invalidating your contract and they will take your deposit and leave you with nothing.

Appeal to their good nature and see whether they will give you any help but i seriously doubt it. Just grit your teeth and look forward to the car when i eventually turns up!!!

This problem could go on for weeks, I understand they do a delivery service which will cost me £100, but its the fact I will have no car to get to work in, for however long, until the car gets here.
I will cost me a fortune in taxis !!

I understand your probs and how you feel but unfortunatly they list that they are not going to be held responsible for any delay. When you pay the deposit and accept their terms and conditions then you agree to this. Thats where they have got you. As i said, appeal to their good nature but dont hold your breath though!!
