Having read through the thread I think I would fight it. I worked for a large firm of London solicitors and due to health problems was off sick for 2 years being paid % of my salary under their income insurance policy. It was known that I would never be able to return to my position and in the end the insurance company sent a person to see my about medical redundancy. My employers didn't have a proper HR department just an administration department who basically didn't have a clue. They employed another top London firm of solicitors to argue their side and I found myself an employment specialist out in the sticks where I live. My solicitor found that I had been discriminated against with regard to sick pay by the firm and also by the insurance company who paid my 'salary' whilst absent.
I hadn't been kept uptodate of changes made within the firm amongst other things. When my solicitor went through my working history with the firm he found that I'd been discriminated against on many occassions and were also in breach of my contract on a few counts. Just the mention of this to them and their legal team added an extra £10k to my payoff.
Although the firm I worked for were a large corporate bunch they had scant knowledge of employment law. They ended up paying my solicitor thousands for advising me and in order to ensure they were treating me fairly my employers paid their solicitors to advise me on how to get the payment tax free. Result! Don't be daunted. In this current climate I think you need to fight for as much as you can. I am now in a position to return to work but there are no jobs available to apply for so am thinking about retraining for a fresh start! Good luck whatever you decide to do. By the way I was also paid a few hundred to keep my mouth such about the terms of the agreement!0
