Help with a Halifax offer.

Hi I just wrote out our story and posted it but can't see it anywhere, I am new to posting although not to reading everything on here. Our story is as follows. We had a current account with Halifax with an arranged overdraft of £1000.00. In November 2008 I wrote asking for £2500.00 of charges to be repaid as my Husband had become permanently disabled and his S/employed business was no longer. I explained to them that he was also suffering from severe depression and Ithought he had been dealing with things only to find out he hadn't hence the exceeding overdraft limit.

At that time the current account stood at £1500.00 and still does. I requested charges only back to when Hubby was no longer able to work They said no. So I wrote again under F/H and again they said no but if I would like to send in an I/E form to feel free. At some point they changed the current account to a cardcash account without notifying us. So I sent the I/E form and also another covering letter explaining circumstances and £1600.00 of priority debts etc. I didn't here from them for many weeks so I rang them to be told that some of the entries on the I/E form needed clarifying (although they never asked for this prior to my call) which I duly sent off.

I had a letter last week saying that we are in F/H and the charges are fair blah, blah but offered me £470.00 as goodwill gesture because of our circumstances. I rang them and asked how this would help as it is less then our amount exceeding our overdraft limit only to be answered by silence. I then asked if they would pay this into our card savers account so I could pay some priority debts with it only to be told they wouldn't do that and that I just had to put up with what they had offered. I then said I would go to the FOS, I rang them to start the ball rolling and then rang Halifax back to say I had done so and would they reconsider to be met by another negative!!

So I now have the FOS paperwork but wonder what anyone thinks should I try Halifax once more or get on with the FOS. Their offer does nothing to alleviate our hardship and I thought that was the ideal! Any thoughts/ advice. Many thanks.

  • Hi there, I can't help unfortunately but have been given a similar response. My claim went in in February and finally received an offer last week of just over £130. My charges and interest are £1000 and I am £270 over my overdraft due to charges so their offer really won't help at all! I sent them the court letter last week and called today after receiving a demand to bring my account back within my agreed overdraft (which I can't and won't do - I'm in financial hardship and by my reckoning they owe me more than I owe them:p). Spoke to customer relations who said basically this is their first, last and final offer and if I don't accept it I'll have to wait until after the hold:mad:

    I have decided to go to the FOS (completed online, printed and posted today) after speaking to them on the phone and reading in the guide that I can still go to court after if I'm not satisfied. FOS said that normal cases are taking 3-9 months but hardship cases will be quicker and because they've made me an offer it will make it easier for them. Basically they'll review the case and if they don't think it's fair they will make the bank offer a fairer amount.

    I have also sent Halifax customer relation a letter telling them I have referred this to the FOS in the vain hope they change their mind (here's hoping:rolleyes:)

    Hope it works out for you, I watch everything related to Halifax and they do appear to be one on the worst. Your offer is like mind, how do they think their offer of £470.00 against an overdraft of £1500.00, £500.00 of which exceeds my limit is going to do anything to help my F/H circumstances. There are £2500.00 of charges owed and that isn't including any interest!!

    My first thoughts are have you included all charges from July 2001? Did HBOS look at household income? Have you been threatened with court action on the priority debts?

    Hi there, first thank you for replying to my post. I did not include charges from that far back (2001) as I have already claimed some back a few years ago hence I only asked for charges from when my Husband became disabled, also thought they might think "fair play"! Yes, they looked at household expenses very thoroughly. No, I haven't threatened court action on the debts only rang them saying their offer did nothing to alleviate circumstances or prority debts. what do you think? Should I ring again and threaten that action?

    Hi sorry, I have just re-read your reply and see you meant do I have any court action threatened on our debts. Yes ,on the priority debts 2 are threatening and 1 wants to take payments from our benefit, we have £19,000.00 of other debts and they are all taking action. sorry I misread you earlier!
