The Dispute Service (TDS) delays and procrastination

  • Thought I would jump on here and give you a run down of my experience...Like Pepzofio, can feel my blood pressure raising thinking about my LA and TDS!
I gave 1 months notice on my house back in September 08 to move out October 08. I was on a month by month Periodic contract, after I gave the notice the LA said they wanted 2 months notice. I consulsted Shelter and they said this was not the case, I only needed to give 1 months. I tried to resolve this with the LA who turned out to be nothing but obstructive, rude and generally unhelpful. Needless to say I moved out.
They LA did not return my deposit.
I submitted a claim with the TDS mid November 08. According to TDS my claim is now with the Case Examiner to rubber stamp the decision that has already been made and has been at the stage since 21.2.09. I ring on a weekly basis and am told different info on each occassion, it is sooooooo frustrating.........If it was not for the fact we are talking a pretty large amount, I think I would just give up.
Good luck to anyone trying to claim as I do not think their 40 day processing time is on track, I am nearly on my 6th month!!!

I to am having problems with the TDS.

The service is totally biased against LLs and as such would never use this service ever again. The staff are incompetent and the adjudication process is a joke.

I can see I am not alone here.

Spread the word "DO NOT USE THE TDS", even though your case may cost you to contest, take it to court, the TDS is run by non-legal staff who quite clarly do not know what they are doing. AVOID AVOID AVOID.

All the other posts on here have been about poor administration, not about wrongful decisions. Read the thread properly before jumping on with your bandwagon.

Yorkie1 - No they are not, I suggest you take another look, but regardless, I will post whatever comments I feel are appropriate so please don't tell me what or what not to write. You clearly do not know how to use this forum so perhaps best to leave it to those that do.

My daughter and her flatmate had to go through the TDS system after their LL wanted to keep all their deposit. TDS were quick, efficient and my daughter and friend got every penny of their deposit back. So there are good stories as well bad.
    It's someone else's fault.

Okay let's look at this thread, shall we Trebor1? Of those people that posted specifics about their experiences with TDS:

Post 1 = about how long it was taking them to resolve the dispute, outside their given timescales.
Post 3 = about inconsistent stories being given (so, clearly their administration is poor), together I accept with a wrongful refund.
Post 9 = about failure to respond within the proper timescale
Post 12 = about failure to deal with deposit return within timescale.

Just before posting your comment on this thread, you'd started another one on your own experiences. As of course you are perfectly entitled to. But you used this thread, which was not about wrongful decisions but about incompetent / untimely administration, to perpetuate your comments.

I was just pointing that out. Just as you claim entitlement to post what you want, which you do within the rules of this forum, I also claim entitlement to comment on your post.

There is absolutely no need for you to descend into abuse about understanding how to use a forum. But then again, I do note that you've been abusive to another poster on your own thread, so I guess that's your understanding of how to use a forum.

Yorkie1 - It's Trebor01 not Trebor1, you may be having yet another go at the wrong person , so it might be worth getting your facts straight before replying. As for your insults I think you need to learn to practise what you preach as you seem to be "all wise and mighty" in other posts I notice, and yet feel obliged to insult my own management abilities without any knowledge of who I am.

I would never judge anyone I did not know but you seem to think its OK for you to do so. It's not, so I suggest you take note, and drop the insults.

Dodger1, lucky them, but in this case the TDS have taken over 3 months and the report produced is factually incorrect, even though they have all of the evidence they need. The TDS have also stated (in writing) that it is OK for a LL to produce a check out report, and then in their own report stated they have not seen this "independent" report, totally contradicting their own processes. They clearly have no idea what they are doing, and whilst I accept when things go in your favour you are not really going to see any fault with a service, the general point of this thread is about poor service !!!!

I missed out a zero, for which I apologise.

Notice you didn't have a valid reply to my substantive posts though.

Yorkie1 - That's because you seem to like to advise everyone about issues when your points in my opinion are wrong, and then seem to think it's OK to add in insults which I find offensive especially when hidden behind a mask on a forum, and due to this behaviour think that it's simple not worth bothering to reply to these points.

If you can't add value, which clearly you can't, then don't reply.......clear....good, time for you to run along and annoy someone else
