Can company charge me a £12 for a cheque that wasn't received?

Hi,

I have received a cheque today from a company that was owing to me.

The cheque was due over 2 weeks ago and I rang them a week after expected arrival date to say I had not received it - I was told I would have to wait until 14 days had past from the original post date before they could reissue a cheque.

The cheque is £12 less than I expected - the letter enclosed states this is due to having to cancel the original cheque. I have rang and spoke to them asking why I have had to pay cancellation charges, when surely it can't be my fault if I haven't received something.

I was told that as they got charged from their bank, they have passed the charge onto me. I said that the charges issue is between them, their bank and Royal Mail.

The Office Manager is supposed to be ringing me back (however not very hopeful) this afternoon - any thoughts,ideas or advice that I can empower myself with?

As usual it is the principal of the matter - I wait all that time and then am charged £12 for the privilege!

    It is likely the bank charged them for cancelling the cheque, if they would have reported the cheque lost they wouldn't have been charged.

    This is rubbish.
    If they want to send out a cheque in the post, it is up to them to take it up with Post Office and get recompense from them.
    As far as you are concerned you are entitled to a full refund.
    You could even offer to give them your bank account details and get them to send it via BACS.

    Just had another thought. As you were not paid on time why not impose a fine on them for late payment and the costs you have incurred in chasing it up. £12 sounds about right to me!

    One final point if a cheque is lost in the post my bank does not impose a charge for stopping. You might want to mention this to them as well.

    After ringing them back (needless to say, they didn't call me!) and talking to an obnoxious manager (fortunately this doesn't wash with me) - I have just had a call from the original person to say that the General Manager has agreed to pay the £12 to me - common sense at last!

    Makes you wonder what would happen in these circumstances if I wasn't such a bulldog (in attitude, not looks :rotfl: )

    Anyhow thanks for your replies and it is good to know that as ever there is normally somebody out there that can offer some sound advice :T
