Insurance co. taken direct debit early

i've got an agreement with a company for insurence on my sky digibox, taken annually by DD in october, yesterday £72 quid was taken out of my account on the 1st with no notification.

i've rung up and after queueing for neary 90 minutes on 3 seperate occasions finally got through to customer services who spoke to billing and confirmed it was a failing on their part, and they're very sorry, and to let me know that their guidelines say it can take up to 28 days to refund me:mad:

This will cause me major problems as i'm not paid again till the 15th, i've tried ringing again today to speak to them to register my unhappiness but gave up after sitting on hold for 25 minutes again, i've also been in to speak to my bank after being advised by a friend that this is considered illegal under DD regs/small print. However the bods at my bank have said there's nothing really they can do, if i were to push the issue perhaps they could file an indemnity but that could take up to 28 days and could also interfere with whatever refund the company may be putting in place.

I can't believe that this is correct.

    A Direct Debit Indemnity Claim means the bank have to refund the money immediately into your account and then they chase it from who ever took it. The banks don't like doing it so they normally try and fob you off as they have with you

    Go back to the Bank and demand an immediate refund... this is what the Direct Debit Guarantee says:

    1) Ring up your bank and use the direct debit guarantee the money will be back the same or next day

    2) Cancel the overpriced Sky warranty sky will come out and fix faults for free if you threaten to cancel
