Are Newmans still acting FOR Amex, or have they purchased the debt?
How much is it for?
Amex are one of the few creditors who will actually fork out to make you bankrupt.
Get a CCA request off ASAP anyway.
I'm unclear on whether the debt has been bought or whether Newman's are acting on their behalf. The letter I received from Newman's stated the debt had passed to them due to non payment with a previous DCA, but the way the bloke at Newman's spoke on the phone was as if I owed them. They do have access to Amex via computer as far as my account is concerned, as he had to keep pulling up data as I spoke to him.
The debt is for approx. £1170.00 but they are quoting £1260.00 due to the missing payments.0 -
Sounds like it is still with Amex, but hard to be sure. If it had been sold you should legally get a "notice of assignment", but some creditors DCAs seem to be too lazy for. :rolleyes:
I would be surprised if even Amex would really bankrupt you for that amount. It would cost them more than that to do it. But again, you can never be totally sure.
Get the CCA request off. Until they comply with that with a valid agreement you would have good grounds to get a statutory demand "set aside" (costs nothing) even if worst came to worst. I am fairly sure that I cca'd RMA a year or so ago and they eventually managed to come up with the goods, but anymore delaying tactics will be handy at the moment.
I was offered a full and final settlemet of £1,000.00 by Newman's but that is way too high to be able to raise or even seriously consider.0 -

My daughter has for you to fully investigate this matter but you don't listen or acknowledge our request or her complaint is not dealt with. I have asked your staff to take it to court because I have the proof its being paid. Constant harassment has been experienced by my daughter and myself and they are abusing me by ringing my home not my daughters and then to leave messages threatening court action, your staff keep stating they are not receiving nothing from her. If you ring my home phone again I will take you to court because my daughter does not live here. The reference your staff are quoting is 1B129120. This is not the correct name of my daughter either or the account she is paying it through. I have constantly complained about the harassment and service you are providing and the incorrect information you are using but it falls on deaf ears. Mr Harrison tonight was also very threatening and left a message threatening on my answer phone. I am going to pursue this to the OMBUDSMAN as the anxiety and stress has been shocking for my daughter. You deal with people who don't pay but she has and still is but you will not listen.

For the past 8 years RMA have been good. No chasing as such, have taken my word when I've not been able to increase payments. In fact they have pretty much left me alone. It is only now that they can't trace these three payments they have caused me any problems.But what DCA is going to get a good review?

I've just been on Newman's website and see they are members of CSA.
I noitice quite a few guide lines that they have already broken. I'll save that for after the cca request though.
I'll wait to see what Newman's put in the letter before sending off the cca request. Hopefully I can get away with sending off the cca request after Easter, drag the process out longer.0 -

I wouldn't bother about the CSA. The head of the CSA is on the board of 1st Credit who have just been slapped by the OFT.
Complain to the OFT and trading standards.

Thanks for the heads up on that. I did have a short dealing with 1st Credit but that reverted back to the original card company. After a few complaints and reductions of balance by way of compensation, that one should be paid off soon. Would be nice if I could get this one to go the same way. As I said earlier, I have emailed, the local TS Office to Amex in Brighton, so I'm hoping for some leverage there.And I've read some real horror stories about RMA. It can be a bit random.

As much as this gets stressful for me at times, I will be determined to cause these people some stress in return.
I know what you mean about RMA, I have read some horror stories on here too. Can't beleive how lucky I'd been up until now.0
