Urgent advice needed. Please!!!!!!!!!!!

Advice needed please.
I have an Amex debt that I've been paying through RMA Resolve. The last three payments I payed by internet bank transfer. RMA claim they can't trace the payments and now Amex have passed the debt onto Newmans DCA who want almost 3 times as much per month or will pass the debt onto their legal dept. with a threat of Bankruptcy and charging order on my home.
I've sent proof of the payments to RMA, I've got a stay of execution for 2 weeks, if I make a payment similar to the RMA amount tomorrow. So basically I'm getting screwed over because RMA have lost my payments or actually screwed Amex over for a few quid.
Any Advice?

    keep calm mate.
this happened to me...turned out the reference number i had typed into the internet banking was incorrect so the payment went into a black hole. they found it eventually. I suggest you double check your internet banking details to RMA...and fax them proof of payments with your details.

I've already sent proof of payment to RMA. Not heard anything from them since. Then I get the letter from Newman's. I've quoted the reference no.s etc. back to RMA and they haven't highlighted any errors. I've also rechecked the numbers a few times myself and see nothing wrong.
I've just written a letter to Amex letting them know I'm not happy, the payments were made and it should be between RMA and themselves without the need to get Newman's involved who now want more per month than I can afford.

advice as above, double check all your details making the payments.

If all your payments are correct, send a letter to Newmans saying you are dealing directly with RMA as the account is in dispute. They shouldnt take any further action.

Would also send further letter to RMA saying something along the lines of, you have made payments, you have enclosed proof (you could double check with your bank that the payments have definately been transferred and not just taken out your account) and that you are extremely upset they have decided to transfer your account. Give them two weeks to sort out their end and ask them for proof your account has been adjusted otherwise you will take the complaint further.

    Just another possible suggestion..

    Hi mm2000

First of, and easier said than done, stay calm.

Depending on how much the debt is for it is most likely that Newmans are just blustering. Work out what you can pay them and pay it and not a penny more, it shows willing on your side, don't let them bully you. Is it Newmans or RMA that have given you a stay of execution?

As for the money that has gone into a black hole. Have you spoken to your own bank about it to see if they can help you trace it?

It's Newmans that have given me the stay of execution for 2 weeks provided that I make a token payment tomorrow equal to what I'd ben paying RMA Resolve.
It is Amex that have moved the debt onto Newmans not RMA. I've been dealing with my debtgs for 8 years now prety much trouble free, everything running fairly smoothly and now this.

I've not had a chance to get to the bank yet. Probably won't until Monday.
  • Is RMA an organisation that is running a DMP for you?

How much do you owe to Newmans?

RMA Resolve were/are the DCA that were collecting the debt on behalf of Amex. I had always previously paid by cheque, but when they provided the banking facility it made sense to use that instead of the cost of a stamp each month.
Newman's have quoted the balance at approx. £1260.00. But that does not include £90.00 in payments that RMA have lost.
Last night on the phone, I was told Newman's would require approx. £84.00 per month. I've been paying £30.00 and had at least another 3 months to go on that with RMA before they stuffed up and lost the payments.
I telephoned Newman's this afternoon and had a bit of a row with the bloke. I tried to tell him that Amex could not pass the debt onto another DCA whilst there was a dispute on the account over the payments. He felt otherwise. I told him that I would pay the £30.00 agreed last night which he said was a one off but I required a letter from Newman's stating they would take no action for two weeks. When I received the letter I would send a cheque, not make a payment over the phone. He accused me of stalling tactics. Well Derrrr. What does he expect.
I think I'll throw in a cca request for good measure. Hopefully that will waste a bit more time.
I've written to Amex today asking for the details of there complaints procedure. I've also emailed Amex's local Trading Standards and reported them.

Any further help or advice? Does anyone know for sure where I stand with the dispute and whether Amex can lawfully pass the debt to another collector? I have had a similar scenario before with Barclaycard and Citicard, but I've just written to the DCA's and Original card companies and everything has been sorted fine.

Are Newmans still acting FOR Amex, or have they purchased the debt?

    How much is it for?

Amex are one of the few creditors who will actually fork out to make you bankrupt.

Get a CCA request off ASAP anyway.
