Incorrect label for product - false advertising?

Long story short, bought a bath which was delivered wrong. Turns out the woman in the shop had looked at the ticket next to the bath which said "MODEL X" and gave the barcode, but turns out it wasn't MODEL X at all, it was MODEL Y, and the incorrect bath was delivered.

After much other faff, I'm currently writing to head office, and want to know if this is false advertising or any other trade description type issue?

    No, it's human error, it happens. You do however have the right to have the wrong bath collected at no expense and minimum inconvenience to yourself and replaced by the right one.

    thanks Bookworm. I do appreciate that human errors do happen, but in this case I'm getting the blame for not checking that the barcode was correct and for not checking that member of staff noted the correct barcode which I am not happy about so wanted to check all terminology out for my nice letter to them.

    The Sale of Goods Act requires the products to be "As described" so if the bath isn't the one you've ordered, then you are entitled to have that remidied at the retailers expense.

    If they are just sounding off and trying to make themselves look good, then fine. But if they are expecting you to pick up any of the bill for their mistake then do not stand for it!
