CCS "bailiffs" intimidating

Hi Guys

This morning i received a call from a lady that i rent my house to saying that there were 2 bailiffs at the door demanding 680.73 for 1 days unpaid congestion charge.
The so called bailiffs had clamped a truck that belongs to me (its used for business) and were frightening her demanding access to the house to remove goods. when her son went to the vehicle to remove something of his (they believed it would be towed away) they barged past the door and gained entry to the property. they then preceded to tell her they where going to remove her property !!
I contacted the so called bailiff to be told that i had to pay or they would take goods, i reminded them the house was let out and that the contents were the occupants, to which he said tough

I have had no contact with The issuing court or the bailiff company and wonder how a nine pound charge can end up at this figure. The lady that rents the house in in pieces crying and extremely upset as she is recovering from a major operation.

I am still not sure if i owed the money or not but paid to save this woman any more hassle. I am disgusted that a company can turn up on someones doorstep and do this. I would love to know how and what to do to firstly complain (to anyone and everyone i can) then to get money back for the way this has been handled. This has to be illegal :mad: :mad:

    This is VERY interesting.....

    In the first instance the fees do not appear to be correct and I would seriously suggest that you send a letter to CCS to make a Subject Access Request for a complete breakdown of the fees and charges.

    Next, from reading this post it would appear to indicate that all statutory notices had been sent to your previous address. If so, then you can file an Out of Time Late Statutory Declaration. In the first instance you need to call the Traffic Enforcement Centre to establish the date that the Warrant had been issued to a bailiff and secondly, to ask them for the address on the original Warrant of Execution. This is vitally important.

    thanks i sent one off yesterday, another point is that both men were reluctant to show any id. When i was talking to them on the phone one accepted that he was mr ****** i then rang back a diferent person answered and pretended to be the same person. they said they had no bailiff id number and werent required to carry one (this i know is untrue) but he did say he was a certified bailiff (in fact both said they were but cant have had the same name) .
    The lady of the house asked to see id also and he showed something through the window, she called the police and there attitude charged dramatically. they knocked 200 quid off the bill still as per above as there waiting time was negotiable (lol).
    I am fuming still that people can get away with this, i will be writing to TFL CCS and a goverment body if i can find one.
    What happens if in 40 days i hear nothing from them

    Several things don't sound at all right.

    Firstly the vehicle - If it is used personally for business, then it can't be clamped. However bailiffs can it seems get away with pleading ignorance. This can also apply to seizable goods that belong to someone else. :mad: The onus is on the OP to inform them I'm afraid.

    The OP would be well advised to get an inventory of seizable goods and work property at that address together ASAP. Partly for their own info, should they try to sieze anything else/protected goods and partly so they can inform the baliffs about the likes of the vehicle and to differentiate between any tennant property, which can't be touched.

    Once informed, they should leave it well alone. The usual on confirmation would apply - The baliffs probably won't oblige with an a prompt acknowledgement, so keep copies and get proof of postage at very least but recorded/registered delivery would be better still.

    The £680 charge sounds unreasonable in the extreme. Esp for just one day but they need to see a clear breakdown of the charges before a proper opinion can be given. I also have something at the back of my mind about TFL not authorising clamping until three days unpaid CC is logged against a vehicle but that may apply to on-street only?

    Equally, the OP needs to know just what type of baliff is involved and what powers they are operating under. The report of the stroppy behaviour and playing coy with their ID also makes me wonder - Very unprofessional.

    Hmmmmm got a letter from the customer services saying no need for the ten pounds as they dont charge for this service, makes you laugh the jump up there charges and dont accept money there legally allowed to take :beer:

    more to follow no doubt no responce to my complaint ill wait for me sar 7 to arrive

    ok they have sent me a breakdown of fees but no copies of any paperwork i was requesting so 1 mistake.

    the fees are as follows
    17/02/09 debt 185.00
    18/02/09 dvla check 2.50
    19/02/09 Pre enforcement letter 11.20 + Vat
    12/03/09 Visit fee one (some one in house on that day as lady of the house was off work as previously mentioned) 54.94 + Vat
    12/03/09 attendance and van ? 144.50 + Vat
    01/04/09 visit fee 2 58.81 + vat
    12/03/09 attendance and van ? 144.50 + Vat
    these figures dont match what the bailiffs left the lady with and also dosent math the receipt i have for the money paid
    ie i paid 681.73 there total is 681.45 small difference i know but still a diference.
    so i looked at a notice of seizure od goods and inventory on there it has bailiff fees on 462.60. none of there figures add up correctly.

    I i right in thinking they cant charge for a attendance and a van and a visit fee !!
