V5 issues and the DVLA
I was recently sold a 'dead' car that I have been trying to return for refund for the last few weeks under the SOGA. The 'dealer' showed little to no interest until he discoverd that I had tracked down his home address and was ready to issue court proceedings.
My question is this, when (and if) he returns my money, he'll be wanting to take the keys to the car (he can't take the car without a tow truck). Now when I bought the car it had no tax on it so I immediately went out and taxed it. Obviously at £100+ I don't want to send the car back to him with the tax disc, but because we only bought the car a few weeks ago we have yet to receive the relevant docs from the DVLA.
Without a tax disc, and parked on the roadside, I'm guessing it is liable to get in all sorts of trouble. Is it possible to just ring the DVLA once I've got the pennies back and inform them of a change of ownership? There's no guarantee that the 'dodgy dealer' ever sent in the V5 in the first place, but I want to make sure that once the cash and keys have been exchanged that is the end of my dealings with the car and that any problems from there on in is down to him, and not me.

If he doens't send the v5 in then as far as dvla are concerned he is the legal owner and liable for tax etcLife is about give and take, if you can't give why should you take?0

In order for you to claim a refund on the tax disc you must be either the current or previous registered keeper. So your name must be on the logbook for this to happen. Did dealer send off logbook? Do you have V5C/2 (green slip)?
