Problems with Asda warranty

Options
Hi
Need some advice from anyone out there.
I purchaed an IPod classic in October last year, and for some reason it has stopped charging. I have done all that apple suggests (made sure software is up to date etc) but could not rectify the problem.

I rang my local asda and advised them of the problem - the main one being I could not locate the receipt!!! although I still had bank statement with card transaction showing and original packaging.

Over the phone they said they would willingly exchange the item as they would accept my bank statement as proof of purchase so I went down to the store tonight.

When I got there a rather obnoxious manageress was called who said there was no way she could give me an exchange as the amount on the bank statement could have been for anything - it does not prove I bought an ipod!!! I explained that I had been advised otherwise over the phone, but she didnt want to listen and walked away saying - quite patronisingly - i'm sorry sweetie but i cant help'!!!

Sweetie!!!!!???? I swear if my daughter hadnt have been there I'd have swung for her.

Anyway I'm left with a broken ipod that although is in it's warranty, i cant get exchanged. What can I do?

Put your complaint in writing to the store manager. Your rights under the Sale of Goods Act are not dependant upon having a receipt. A bank statement would be admissable in court as evidence on the balance of probablilities that the entry in the statement related to the purchase in question.

Thanks guys - you've spurred me on to keep fighting.
One thing though - When I bought the ipod there was an offer on for half price speakers so I bought them both together. Therefore the amount on my statement is about £10 dearer than the value of the i pod.
    Will this make a difference?
I mentioned it to the manager stating that surely Asda should have a list of transactions from that store to be able to trace the receipt, but she just laughed at me and said 'we dont have records that go back as far as October'! I thought records of financial transactions hd to be kept for at least 3 years?

All that is required is proof of purchase. Proof of purchase can be a bank statement. It isnt always though.

It would be a lot more admissable if it said Apple etc however as Asda sell millions of items then its forseeable that they will need more concrete proof.

As for Hailz - unless its registered Ipod probably wont help, if its registered then its the easiest suggestion but the SOGA crew will probably demand legal action

yeah I did get her name - made sure of it.

Not of her though cause she was too busy to listen to me and as soon as she had enjoyed the sound of her own voice for ten mins, rushed off for her coffee break!
