CAN the CSA use CTC when working out an assessment?

  • kellogs if the csa did included the ctc/wtc in the assessment and the pwc thought this was unfair, could the pwc ask the csa not to use this amount in the calculation?

    No as it is part of the way that it is supposed to be calculated.

    PWC could always give back the relevant % of the tax credits if they felt that strongly about it though.

    so if the pwc gets benefits and ctc how does this have an effect on what the NRPcontributes?

    Any tax credits the PWC gets does not affect maintenance assessments - on CSA2 anyway.

    We have never been asked what tax credits we receive and so have never told them. DH is an NRP.

    i really don't think the CSA enquire as to how much CTC PWC receive when working out CSA fromNRP

    They don't, but they should be asking the NRP how much tax credits they get when calculating how much they pay the PWC. ON the forms it will ask what income you have other than your salary, this is where you should put the info - if you don't then you have made a false statement. If circumstances have changed since you put in the forms, then unless you are asked you are not obliged to tell them.

    i meant if the PWC is receiving the tax credits they don't take that into account when working out wot the NRP should be paying even tho the NRP doesn't receive any tax credits at all

    Why would they anyway? The assessment is done on the NRP income and PWC income is irrelevant.

    so if the PWC was minted and the NRP was worse off thru divorce then they still don't take into account the PWC's income

    seems very unfair to me
