CAN the CSA use CTC when working out an assessment?

                    I'm just asking because when looking at the CSA website it doesn't actually say that CTC is included in net income. It says that 'in certain circumstances' tax credits may be included. But it doesn't say what the certain circumstances are?

 WTC is included in full if the nrp is the higher earner, 50% if nrp and partner earn the same amount, and not at all if partners income is higher.0

            as a NRPP i was told that CTC are not included and ours never have been. especialy as i argued with CSA that we only recieved CTC cuz we had kids so therfore the money is not for us but for the kids we are on new rules incase it makes a difference?I'm often on call :Aso if I suddenly dont reply then i might be out saving a life :j or i might just be having a ciggy:D :rotfl:

            articfoxy78, I was assuming the OP was asking about new rules cases too. I took the response in post 2 from a more detailed guide a few years ago.
 I can assure you CTC is included, but I also know it is dependent upon the caseworker remembering to press a correct button.0

            when hubby was working 12 months ago they only took his wages into account,no WTC no CTC no CB(we were getting all 3) when he went on sick with depression and knee problems(delivery driver) they took into account sick pay and WTC they enquired re CTC i argued with them that if we didnt have kids then we wouldnt have CTC so it shouldnt be included CSA called back later that day(yeah i know i nearly fainted too) and agreed that CTC and CB are not used in calculationsI'm often on call :Aso if I suddenly dont reply then i might be out saving a life :j or i might just be having a ciggy:D :rotfl:

            We get CTC but only the lowest amount, about a tenner a week, and we don't get WTC at all. They have never asked us about CTC so it's never been included - we are on new rules. I just ask because we've sent DHs wageslips off for a reassessment as his wages have gone down. Our case is technically stuck in Newcastle :rolleyes: so I'm not sure whether they'll have all the details about us having one child together. If I have to remind them, it may jog their memory about the CTC!

            They told me when they called me that they would take CTC into consideration YET now they've done the assesment they havent taken it into consideration and ive just been told to pay the flat rate of £5 per week.0

            BE mindful that they may correct that decision and include it backdated as it MUST be included if it is CTC and if WTC if NRP earns more it will all be included and if they earn same as NRPP then half is included and if they earn less then it is not used.0

            It depends on why they hadn't been informed - if you were asked and failed to put it on the forms then it would be backdated, but if it was never asked for it may not.0

            Hi kellogs, what would happen if you were never asked if you were in receipt of child tax credit and you had never completed the form, if it was all done verbally over the phone. Would the csa not backdate it then as there was no proof and the error was theirs? Also if it was backdated (even though it was thier error) i am assuming it would be at the rate when the information was collected - earnings etc not when the decision was actually made.
 are they supposed to check for this or does it depend upon the case worker as from cmec it won't be included anyway - is that on all csa cases from 2011-2013?? not sure of the dates. do you know if it will be a general date for all or will it be on a sliding scale??
