My sympathies Kittykat, as I have been there, and you are fighting the system, but it can work.

My back garden backs on to other back gardens, all our houses do, seperated by 6ft fences, but one house has 3 dogs, and they continually, if I walk down to the end of my garden to go into the shed, the dogs on the other start, but thats not the best bit, they set off the other dogs, and its horrendous, this has gone on for years, and the barking lasts for hours.

We all live in Semi's, and i cannot fathom out why the neighbours on each side dont do anything, but I think they are terrified of the family.

Like I mentioned on another thread 'noisy neighbours' about the noise abatment people, I rang them, and i had the phone in my hand speaking to them, my phone is cordless, I am in the hall and I could hear them, bearing in mind, my garden is approx 120 -150 feet long, so I have moved by the back door, and said to the woman, 'listen to this, and this is at the very end of my garden', the lady knew the houses where I lived,so she knew how long our gardens were.

She said it horrendous, but her hearing it does no good either, they have to send someone round with a monitor to measure the sound, etc, she also suggested that I contact the animal welfare, as the dogs were kept mainly outside all day.

In the summer its worse, you leave your patio doors open, then 5 mins later you had to close them as you couldnt hear the TV or even yourself think, they did move about 4 months later, so we just have the odd barking dog now.
  • This extract is taken from our local council web site.

The main forms of noise nuisance that we can deal with are:

    Domestic Noise
    Intruder Alarms
    Barking Dogs
    Loud Music
    Car Alarms
    DIY
    Motor Repairs
    Our complaint procedure
Once a noise enquiry has been received we will send you log sheets to complete with details of the nuisance and we will give you the name and contact number of the investigating officer.

These sheets need to be completed in as much detail as possible as they will help the officer decide whether the noise may be a nuisance or not. In addition information on the procedure will be sent to you.

We may offer to send a letter to the subject of your complaint informing them of the problem, advising them of courses of action that could be taken and the possibility of monitoring equipment being used.

If the nuisance persists you need to complete and return the log sheets. On receipt of these the investigating officer will contact you within 5 days to discuss your complaint.

If the log sheets are not returned within 4 weeks we will send a reminder letter inviting you to return completed log sheets. If we do not receive anything within the following 2 weeks we will assume that the problem was either temporary or has been resolved and the case will be closed.

If the officer feels that there is a statutory nuisance they will contact you and discuss options for action. Noise recording equipment may be installed to monitor the levels, times and duration of the noise. The monitoring equipment must be placed inside your property.

If there is evidence that a nuisance exists the authority will take formal action and serve an abatement notice, to request that the nuisance stops.

If the nuisance continues then the authority may go to court and seek to prosecute the subject and possibly seize the equipment. In these events you may be required to attend court as a witness.

I will try all the steps you have mentioned and I will buy some earplugs in the meantime I think!

I will let you all know how I get on!

    Thanks again :-)

If you are not happy to approach them directly (which I can undestand)then send them a letter through the post but don't mention who it is from. If you word it carefully then they will not know who it is from. You can say how unhappy it is making you and that while you understand that all dogs bark occasionally you feel that theirs is excessive and is affecting your peaceful enjoyment of your home.

You can also mention that you are hoping for an amicable solution and don't want to have to resort to involving the landlords and environmental health departments with regards to what you think may be perceived as anti-social behavior.

It might work and will cost you the price of an envelope and a stamp.

To get any interest from my local EHO they need three separate complainants so you may have to speak with other neighbours to get them to complain too.
