12month rule

does anyone have the legislation or rule where they can only claim back for 12months,

BGAS have passed on a 3year old bill covering 3months and £67 to a debt company which i have never received or anything else from BGAS regarding it.
Also the period is incorrect as BGAS were only supplier for 2of the months so god knows what the reads are.

told debt company i will see them in court so just issue the summons.

  • The rule is if the company had troubles issuing a bill. So if you called British Gas and said that you hadnt paid for gas that you had used, but they were having trouble actually sending you a bill, then you wouldnt need to pay it. If bills were being sent to the wrong address, or if incorrect bills were sent etc, then the rule does not apply.

    The 12 month rule is only if you haven't had a bill sent for 12 months at a current address; it doesn't apply to old disputed bills.

    Most cases like this are when a customer moves and doesn't give the utility company a forwarding address. They then 'sell' the debt to a DCA who trace you.

    The problem you face is for that sum(£67) they probably will not take you to court, but there will be a 'black mark' against you with Credit Reference Agencies.

    I didnt have a bill sent for 3years or i would of disputed it, i still havent had a bill sent despite contacting the debt company and telling them i havent seen a bill they are talking about.

    Is there anything i can do to stop a 'black mark' being applied, Energywatch ?? get the bill passed back to BGAS and then they would write it off ???

    I think that depends on the circumstances.

    You appear to know the period of the bill as you claim it only covered 2 months and not the 3 months BG claim.

    So it would appear that this is a bill for the end of a period for which you were with BG(correct me if that assumption is incorrect)

    Assuming that is correct, you should have taken all steps to have ascertained what you owed and paid it. Most people achieve this by sending BG a forwarding address with your final meter readings; and chasing it up.

    If that is the case, then frankly you haven't got much of a leg to stand on; and for a relatively small sum it is not worth getting a black mark.

    However if the circumstances are not outlined as above, then if you tell us what those circumstances are, we may be able to further advise you.

    You could pay the £67 ;)

    However, as you have already told the debt company to issue the summons, that sum may have increased by £25 or £30 depending on how the summons was issued. :eek:

    Try not to be too hasty next time you invite someone to issue a summons against you.
